[value] => Das Urteil des Landesgerichts vom 4. Dezember 2015 kommt zum Ergebnis, dass die Unternehmen verpflichtet sind ein Protokoll der täglichen Arbeitszeiten der Arbeitnehmer zu führen.
Die Aufzeichnungspflicht ist in Art. 35.5 des Arbeitnehmerstatuts (ET) verankert. Bisher jetzt wurde die Bestimmung dahingehend ausgelegt, dass sie an die Berechnung der Überstunden knüpft, so dass es nicht verpflichtend schien die Kontrolle bei Arbeitnehmern durchzuführen, die keine Überstunden leisteten. Das Obergericht entschied nunmehr, dass die Aufzeichnungspflicht für alle Fälle gilt, da es ohne vorherige Kontrolle kaum nachweisbar ist, ob tatsächlich Überstunden geleistet wurden oder nicht. Das Gericht begründet seinen Entscheid und damit den Pflichtcharakter der Bestimmung mit dem öffentlichen Interesse der Rechtssicherheit.
Der Zweck des Protokolls
Das sog. Tagesprotokoll dient dazu die Erfüllung der Arbeitszeit des jeweiligen Arbeitnehmers zu kontrollieren. Dabei hat das Protokoll einen doppelten Zweck:
- Einerseits dient es den Arbeitnehmern als Beweismittel für geleistete Überstunden,
- Andererseits ermöglicht es dem Arbeitgeber zu kontrollieren, ob die vertragliche Arbeitszeit erfüllt wurde.
Pflichtcharakter
Die Führung des Protokolls ist für alle Unternehmen verpflichtend, unabhängig von ihrer Tätigkeit oder Größe und muss jeden Tag die jeweilige geleistete Arbeitszeit eines jeden Arbeitnehmers ausweisen. Die Unternehmen müssen gewisse Mechanismen einführen, um dieser Pflicht nachzukommen.

La exigencia de este artículo quedaba condicionada únicamente a la realización efectiva de horas extras, por lo que no era obligatorio llevar este control para los trabajadores que no las hacían. Por el contrario, la Audiencia Nacional entiende que difícilmente se podrá saber si se han efectuado realmente horas extras si no existe un control y registro diario, y justifica de este modo su carácter obligatorio como medida de seguridad jurídica para posibilitar el control de la jornada de los trabajadores individuales así como el que pueden efectuar sus representantes legales.
El registro diario de jornada permite inferir y controlar la efectiva superación de la jornada ordinaria produciéndose de este modo un doble control:
- Por una parte los trabajadores disponen de un medio de prueba para demostrar la realización de horas extraordinarias ya que la empresa tiene el deber de entregar dichos registros mensualmente
- Por otra, los representantes de los trabajadores, en el ejercicio de sus facultades de información y control, tienen derecho a recibir copia de los registros diarios de jornada (art. 35.5 E.T.).
Todas las empresas deben contar obligatoriamente con un registro diario de jornada, independientemente de su actividad o tamaño, y debe reflejar la jornada diaria e individual realizada por cada trabajador.
De confirmarse esta doctrina, las empresas deberán implantar mecanismos para registrar diariamente la jornada realizada de cada uno de sus trabajadores, control que hasta ahora tan sólo se realizaba sobre trabajadores con jornada parcial para el correcto control de las horas extras.
