[value] => Das spanische Arbeiterstatut (“Estatuto de los Trabajadores”) sieht in Artikel 35 im Zusammenhang mit Überzeitarbeit vor, dass Unternehmen verpflichtet sind, die tägliche Arbeitszeit so zu dokumentieren, dass der Arbeitnehmer erkennen kann, welche Überzeitarbeit er im Monat geleistet hat und welche Vergütung ihm dafür zusteht.
Im Dezember 2015 entschied der Nationale Gerichtshof, dass aufgrund des erwähnten Artikels alle Unternehmen verpflichtet sind, die Arbeitszeit aller Arbeitnehmer (egal, ob Teilzeit- oder Vollzeitbeschäftigte und unabhängig davon, ob Überzeitarbeit geleistet wird oder nicht) zu erfassen. Der Gerichtshof begründet seine Entscheidung mit einer weiten Auslegung des erwähnten Artikels und vertritt die Ansicht, dass eine tägliche Arbeitszeiterfassung bezüglich aller Arbeitnehmer die einzige Möglichkeit darstellt, die Leistung von Überzeitarbeit effektiv zu kontrollieren.
Infolge des erwähnten Urteils erließ die Arbeitsinspektion im März 2016 eine Weisung zur Intensivierung der Kontrolle der Unternehmen in Bezug auf die Arbeitszeiterfassung ihrer Mitarbeiter, die u.a. für den Fall von Unregelmäßigkeiten bei der Erfassung oder der nicht Erfassung strenge Geldstrafen vorsah.
Der spanische Oberste Gerichtshof hat am 23. März 2017 das Urteil des Nationalen Gerichtshofs vom Dezember 2015 widerrufen und entschieden, dass der Artikel 35.5 des spanischen Arbeiterstatuts nicht weit auszulegen ist, und dass die Pflicht der Erfassung der Arbeitszeit nur, wie es im Gesetz heißt, bezüglich der Überzeitarbeit gilt, aber nicht hinsichtlich der normalen Arbeitszeit.
Während das Urteil des Obersten Gerichtshofs von den Akteuren im sozialen und rechtlichen Bereich noch analysiert und ausgewertet wird, scheint die aus dem Urteil des Nationalen Gerichtshofs abgeleitete Verpflichtung der allgemeinen Arbeitszeiterfassung deutlich entschärft worden zu sein.

[value] => El Estatuto de los Trabajadores, en su artículo 35, que regula la realización de horas extraordinarias, establece que la empresa estará obligada a llevar un registro de las mismas, de tal forma que el trabajador sepa mes a mes cuántas horas extraordinarias ha realizado, en su caso, y qué importe tiene derecho a percibir por dicho concepto.
En diciembre de 2015 la Audiencia Nacional fue más allá y estableció que, en virtud del citado artículo, las empresas (todas) estaban obligadas a establecer un sistema de registro de la jornada de trabajo para todos los empleados (a tiempo completo o a tiempo parcial y tanto si se realizan horas extraordinarias como si no). La Audiencia razona su decisión haciendo una interpretación extensiva del artículo citado y señalando que un registro diario de la jornada de todos los trabajadores es la única forma de controlar efectivamente la realización de horas extraordinarias por parte de los trabajadores.
Como consecuencia de la sentencia de la Audiencia, la Inspección de Trabajo dictó en marzo de 2016 la instrucción 3/2016, en la que acordaba intensificar el control sobre las empresas en relación con el control del tiempo de trabajo de sus empleados, previendo importantes sanciones si se detectaban irregularidades.
Pues, bien, en su reciente Sentencia de fecha 23 de marzo de 2017, la Sala Cuarta del Tribunal Supremo revoca la sentencia de la Audiencia Nacional de diciembre de 2015 y establece que no se debe hacer una interpretación extensiva del art. 35.5 del Estatuto de los Trabajadores, de forma que la obligación de registrar el tiempo de trabajo se prevé sólo, como señala la ley, respecto de las horas extraordinarias, pero no en relación con la jornada ordinaria de trabajo.
En consecuencia, y mientras la sentencia del Supremo es objeto del análisis necesario por agentes sociales y operadores jurídicos, la obligación que establecía la Audiencia Nacional ha quedado notablemente difuminada.
