[value] => Die Audiencia Provincial von Barcelona hat die Eröffnung eines Strafverfahrens gegen ein Unternehmen beschlossen, das sich zur Kündigung eines Mitarbeiters auf eine Reihe von Mails stützte, die dieser versendet hatte.
Zunächst war das Verfahren eingestellt worden. Das Gericht gab dann allerdings dem durch den Arbeitnehmer gegen diese Entscheidung eingelegten Rechtsmittel statt und ordnete die Wiedereröffnung des Verfahrens an. Diese Entscheidung beruhte auf der Prüfung der bereits zuvor vorgelegten Beweise, d. h. der Mailkorrespondenz des entlassenen Arbeitnehmers. Nach deren Prüfung stellte sich heraus, dass sich darunter auch solche Mails befanden, die der Arbeitnehmer aus persönlichen Gründen an Personen außerhalb des Unternehmens versandt hatte. Das Gericht ging dabei davon aus, dass diese Mails den engen Persönlichkeitsbereich des Arbeitnehmers betrafen.
Nach der Auffassung des Gerichts hat sich das Unternehmen nach Art. 197 des spanischen Strafgesetzbuches wegen eines Delikts gegen den persönlichen Lebens- und Geheimbereich des Arbeitnehmers strafbar gemacht, und zwar unabhängig davon, wie es den Zugriff auf diese Mails erlangt hatte. Das Gericht geht dabei auch davon aus, dass es nicht von Relevanz sei, ob die Mails veröffentlicht worden sind. Für die Erfüllung des Straftatbestandes sei es ausreichend, dass das Unternehmen diese Mails einzig und allein im Rahmen ihres arbeitsrechtlichen Vorgehens und vor dem Arbeitsgericht verwendet hatte.
Aus den dargestellten Gründen beschloss das Gericht die erneute Eröffnung eines Strafverfahrens gegen das Unternehmen.

Aunque inicialmente el procedimiento había sido archivado, finalmente la Audiencia ha estimado el recurso presentado por el trabajador y ha acordado la reapertura del procedimiento penal contra la empresa. La Audiencia en su resolución ha tomado esta decisión tras analizar la prueba que ya había sido aportada, es decir, la diversa correspondencia del trabajador que había sido despedido por la empresa. Del examen de estos correos que habían sido enviados por el trabajador desde el correo de empresa se comprobó que entre éstos había diversos correos del trabajador con terceros; correos que la Audiencia en su resolución consideró versaban sobre la intimidad del trabajador.
En consecuencia, la Audiencia ha entendido que, con independencia del modo en el que la empresa obtuvo esos correos, ésta habría cometido un delito de revelación de secretos del artículo 197 del Código Penal. Estima también la Audiencia en su resolución que resulta irrelevante que los mencionados correos no se hayan hecho públicos pues basta para la comisión del delito con que estos correos fueran utilizados por la empresa aunque haya sido únicamente en el ámbito del derecho laboral y en la jurisdicción social para sustentar las pretensiones de la empresa.
Por todo ello, la Audiencia acordó nuevamente la apertura del procedimiento penal contra la empresa por la comisión de un delito de revelación de secreto.
