[value] => Am 25.01.2017 hat die Bundesregierung den Entwurf eines Gesetzes gegen schädliche Steuerpraktiken im Zusammenhang mit Rechteüberlassungen vorgelegt, der am 29.03. im Finanzausschuss des Deutschen Bundestages erörtert wurde. Kern der Regelung ist die Einschränkung der steuerlichen Abzugsfähigkeit von Lizenzzahlungen und anderen Aufwendungen für die Überlassung von Rechten durch nahestehende Personen beim Schuldner der Zahlungen, wenn diese beim Empfänger aufgrund eines als schädlich eingestuften steuerlichen Präferenzregimes nicht oder nur niedrig (unter 25%) besteuert werden. Der Gesetzesentwurf richtet sich gegen sog. IP-Boxen, Lizenzboxen oder Patentboxen anderer Staaten, die nicht ein Mindestmaß tatsächlicher Geschäftstätigkeit voraussetzen (sog. Nexus-Ansatz). Grundlage des Gesetzesentwurfs ist Aktionspunkt 5 des sog. BEPS-Projekts von OECD und G20, in welchem sich Deutschland zu einer Bekämpfung schädlicher Steuerpraktiken durch Sicherstellung bestimmter Transparenz- und Substanzkriterien als Voraussetzung für die steuerliche Anerkennung der Überlassung von immateriellen Wirtschaftsgütern zwischen nahestehenden Personen verpflichtet hat.
Im Ergebnis sollen hiermit demjenigen Staat die Steuern zukommen, in dem die der Wertschöpfung zugrunde liegende Aktivität stattfindet. Wie bereits bei den Regelungen zu sog. hybriden Finanzierungen (vgl. hierzu unseren Beitrag zur Ausgabe Juni 2013 dieses Newsletters) implementiert der Gesetzesentwurf das sog. Prinzip korrespondierender Besteuerung, so dass der in Deutschland gewährte Betriebsausgabenabzug um so höher ist, je höher die Besteuerung beim ausländischen Gläubiger der Zahlungen ist. Eine Vielzahl der von Deutschland abgeschlossenen Doppelbesteuerungsabkommen, unter anderem auch das mit Spanien, sehen keine deutsche Quellensteuern auf Lizenzzahlungen vor, soweit der ausländische Zahlungsempfänger seine Abkommensberechtigung sowie die Voraussetzungen von § 50d Abs. 3 EStG (vgl. hierzu unseren Beitrag zur Ausgabe November 2016 dieses Newsletters) erfüllt.

[value] => El día 25/01/17, el Gobierno presentó un proyecto de Ley contra Prácticas Fiscales perjudiciales en Relación con las Cesiones de Derechos de Uso, debatido el 29/03 por parte del Comité Financiero del Parlamento. Núcleo de la regulación es la limitación de la deducibilidad fiscal del pago de cánones y otros gastos por la cesión de derechos de uso por parte de personas vinculadas al deudor de los pagos, cuando éstos, clasificados como perjudiciales como consecuencia de un régimen de preferencia fiscal, no tributen o tengan una baja tributación (inferior al 25%). El proyecto de Ley se rige contra las denominadas IP-Boxes, License Boxes y Patent Boxes de otros estados, en que no se requiere un mínimo de actividad económica (principio del nexo). El proyecto de Ley se basa en el punto de acción 5 del proyecto BEPS de la OECD y del G20, en el cual Alemania se ha obligado a combatir las prácticas fiscales perjudiciales a través del aseguramiento de determinados criterios de transparencia y de sustancia para el reconocimiento fiscal de la cesión de derechos de uso sobre propiedad intelectual.
En consecuencia, debería corresponder la tributación a aquél Estado en el cual tenga lugar la actividad. Igual que en el caso de las regulaciones sobre las denominadas financiaciones híbridas (véase nuestra aportación a la edición de este boletín de junio 2013), el proyecto implementa el denominado principio de la correspondiente tributación, de modo que la deducción de gastos empresariales garantizada en Alemania será mayor cuanto mayor sea la tributación para el acreedor de extranjero los pagos. Un gran número de convenios para evitar la doble imposición suscritos por parte de Alemania, como p.ej. el suscrito con España, no prevén en Alemania retención en la fuente en los pagos de cánones si el beneficiario extranjero del pago está autorizado por convenio y cumple con las condiciones del § 50d (3) LIRPF alemana (véase nuestra aportación a la edición de este boletín de noviembre 2016).
