[value] => „Höhere Gewalt“ ist im deutschen Zivilrecht nicht ausdrücklich definiert. Die Rechtsprechung versteht darunter ein von außen kommendes, unverschuldetes und unabwendbares Ereignis, das der Schuldner einer vertraglichen Verpflichtung selbst bei äußerster Sorgfalt nicht vermeiden konnte. Welche Rechtsfolgen sich aus einem solchen Ereignis ergeben, hängt immer von der konkreten Art der vertraglichen Verpflichtung ab, die durch ein solches Ereignis beeinträchtigt oder unmöglich gemacht wird. Wenn beispielsweise der Hersteller eines Produkts aufgrund eines Naturereignisses an der Produktion gehindert ist, kann er sich auf sogenannte Unmöglichkeit berufen und wird dann von der Leistung frei. Er verliert natürlich auch den Anspruch auf den Kaufpreis, denn auch der Kunde braucht dann nicht zu zahlen.
In der Praxis finden sich in Verträgen und allgemeinen Lieferbedingungen Klauseln, durch die die höhere Gewalt definiert wird. So würden beispielsweise Lieferbehinderungen in Folge Streiks oder Aussperrung eine Berufung auf „höhere Gewalt“ nicht zulassen, wenn dies nicht ausdrücklich so vereinbart ist. Denn ein Streik ist nun einmal nicht per se ein „unabwendbares“ Ereignis. Welche rechtlichen Folgen der Ausbruch einer Pandemie wie etwa das Corona-Virus auf vertragliche Verpflichtungen hat, ist von Fall zu Fall zu beurteilen. Entscheidend ist die Frage, ob die Auswirkungen, welche eine solche Pandemie auf einen konkreten Produktionsprozess hat, aus Sicht des Unternehmens unabwendbar waren oder nicht.
Ohne vertragliche Klauseln hierzu kommt es beispielsweise darauf an, ob die Nichtbelieferung eines Herstellers mit Rohmaterial oder Halbfertigprodukten rechtlich als Unmöglichkeit gewertet werden kann oder nicht. Sicher ist dies nur der Fall, wenn sämtliche Hersteller eines entsprechenden Vorprodukts oder Rohmaterials aus Gründen der Pandemie nicht zur Lieferung in der Lage sind. Klauseln zu Höherer Gewalt im Vertrag sollten daher immer auch begleitet werden durch Klauseln, die den Lieferanten bei Störungen in der Lieferkette von den vertraglichen Verpflichtungen gegenüber seinen Kunden befreien.

En la jurisprudencia, se entiende que se trata de un acontecimiento externo, no intencionado e inevitable que el deudor de una obligación contractual no hubiera podido evitar aplicando la mayor diligencia. Las consecuencias jurídicas que se derivan de tal acontecimiento dependen siempre de la naturaleza específica de la obligación contractual que se ve afectada o que se hace imposible por tal acontecimiento. Por ejemplo, si el fabricante de un producto se ve impedido de producir debido a un fenómeno natural, puede invocar la llamada imposibilidad y queda entonces liberado del cumplimiento. Obviamente, pierde también su derecho a percibir el precio de compra, ya que el cliente no tendría tampoco que pagar.
En la práctica suelen encontrarse cláusulas en los contratos y en las condiciones generales de entrega que definen la fuerza mayor. Así, por ejemplo, la obstaculización de entrega como consecuencia de huelgas o cierres patronales no permitirían invocar la “fuerza mayor” si esto no ha sido acordado expresamente, pues una huelga no es en sí misma un acontecimiento “inevitable”. Las consecuencias jurídicas del brote de una pandemina como el Coronavirus en las obligaciones contractuales deben ser evaluadas caso por caso. La cuestión decisiva es si los efectos de una pandemia de este tipo en un proceso de producción específico eran o no inevitables desde el punto de vista de la empresa.
En el supuesto de no existir cláusulas a este respecto, es importante, por ejemplo, saber si la falta de suministro de materias primas o de productos semiacabados por parte de un fabricante puede ser jurídicamente valorada o no como imposibilidad. Aunque ciertamente esto sólo sería el caso si todos los fabricantes de un determinado producto semiacabado o materia prima no pudieran suministrar con motivo de la pandemia. Por lo tanto, las cláusulas de fuerza mayor en el contrato deben ir siempre acompañadas de cláusulas que liberen a los proveedores de sus obligaciones contractuales con sus clientes en caso de que se produzcan interrupciones en la cadena de suministro.
