[value] => Wenn ein Verbraucher eine Ware kauft, gilt der Grundsatz, dass ihm seitens des Verkäufers für den Bezahlvorgang keine Gebühren belastet werden dürfen. Unabhängig davon kann der Zahlungsvorgang natürlich seitens der Bank des Verbrauchers (oder eines Kreditkarteninstitutes) gebührenpflichtig sein. Wenn der Verkäufer für einen Zahlungsvorgang eine Gebühr verlangen will, muss er dies mit dem Kunden ausdrücklich vor Abschluss des Geschäfts vereinbaren. Eine solche Vereinbarung ist überhaupt nur zulässig, wenn dem Verbraucher alternativ eine unentgeltliche Zahlungsmöglichkeit eröffnet wird, die gängig und zumutbar ist. So ist es im deutschen BGB aufgrund einer entsprechenden EU-Richtlinie geregelt. Online-Portale müssen deshalb ihren Nutzern wenigstens eine kostenfreie Zahlungsart ermöglichen. Nach einer Entscheidung des Oberlandesgerichts Frankfurt am Main aus dem Jahre 2016 (11 U 123/15) ist die sogenannte Sofortüberweisung eine für den Verbraucher “gängige“ und “zumutbare“ Zahlungsmethode.
In dem Rechtsstreit ging es um die Frage, ob die Deutsche Bahn über ein Portal, auf dem Flugreisen angeboten werden, die gesetzlichen Vorgaben einhielt, da dort alternativ eine Kreditkartenzahlung mit einer zusätzlichen Gebühr von 12,90 € oder eine Sofortüberweisung angeboten wurden. Der Kläger hatte vorgetragen, dass ihm wegen der möglichen Missbrauchsgefahr nicht zumutbar sei, einem ihm nicht bekannten Zahlungsdienstleister persönliche Daten online zu übermitteln. Das Oberlandesgericht hat die Variante der Sofortüberweisung für ein heutzutage gängiges und zumutbares Zahlungsmittel gehalten. Begründet würde dies unter anderem damit, dass nach jüngsten Umfragen 73 % aller deutschen Internetnutzer ab 18 Jahren das Online-Banking nutzen und damit derartige Zahlungsmethoden sehr üblich geworden sind. Dem Kläger wurde in dem Verfahren vorgehalten, dass er etwaige Missbrauchsmöglichkeiten nicht näher darlegen konnte. Das Urteil ist allerdings inzwischen mit der Revision angefochten worden und es bleibt abzuwarten, wie der Bundesgerichtshof entscheidet.

Independientemente de ello, lógicamente, el pago puede ser objeto de comisión por parte del banco del consumidor (o de un instituto de crédito). Si el vendedor quiere hacer algún cargo, debe convenirlo expresamente con el cliente antes de la conclusión del negocio. Tal acuerdo solamente está permitido, si alternativamente se ofrece al consumidor la posibilidad de pagar sin cargo alguno, de manera corriente y aceptable. Esto se regula así en el Código Civil alemán en motivo de una Directiva europea. Los portales de internet deben facilitar, por lo tanto, a sus usuarios al menos un medio de pago gratuito. Tras una decisión de la Audiencia Territorial de Frankfurt am Main del año 2016 (asunto 11 U 123/15), las transferencias instantáneas son para el consumidor un método de pago corriente y aceptable.
En el caso en cuestión se trataba de resolver si la “Deutsche Bahn”, a través de un portal que ofrece vuelos, observaba las especificaciones legales, pues allí se ofrecía alternativamente el pago con tarjeta de crédito aplicando un cargo adicional de 12,90 € o mediante transferencia instantánea. El demandante expuso que no era aceptable para él, ya que podía suponer un abuso, tener que comunicar on-line datos personales a un proveedor de servicios de pagos desconocido. La Audiencia Territorial consideró la modalidad de la transferencia instantánea como un medio de pago actual, razonable y aceptable. Ello se fundamentó, entre otras cosas, aludiendo al resultado de encuestas recientes que apuntaban que el 73% de los usuarios alemanes de internet de más de 18 años usan la banca electrónica, de modo que tales métodos de pago se han convertido en usuales. En el procedimiento se reprochó al demandante que no pudiera precisar mejor el posible abuso. La sentencia ha sido por el momento recurrida y ahora sólo queda esperar a la decisión del Tribunal Federal Supremo alemán.
