[value] => Das kürzlich gesprochene Urteil des spanischen obersten Gerichtshofs (Tribunal Supremo) bestätigt die Verurteilung mehrerer Mitarbeiter eines Unternehmens zu zwei Jahren Haft und zur Zahlung von 456.340,27 € bzw. 340.650,66 € für die Begehung eines Betrugsdeliktes.
Der oberste Gerichtshof sah es als erwiesene Tatsachen an, dass die verurteilten Angestellten des Unternehmens, das Altmetall erwirbt und dieses dann zu Stahl verarbeitet, mit Altmetalllieferanten Absprachen trafen und Altmetall mit überdurchschnittlich hohen Anteilen inerter Materialien abnahmen. Bei diesen in Legierungen enthaltenen Materialien handelt es sich um nicht verwertbaren Abfall.
Die Angestellten waren für die Klassifizierung des Altmetalls in Kategorien und die Festlegung des Abzugs zuständig, der sich nach dem Anteil dieser inerten Materialien bestimmt. Wenn Sie eine Lieferung dieser Lieferanten erhielten, nahmen sie einen weitaus geringeren Abzug für inerte Materialien vor, als sie tatsächlich auf Grundlage des Anteils dieser Materialien an der Legierung mit verwendbarem Metall hätten vornehmen dürfen. Die verurteilten Angestellten erreichten damit, dass das Unternehmen, das das Altmetall von den Lieferanten erwarb, mit denen die Absprachen bestanden, höhere Preise bezahlte, als es bezahlt hätte, wenn ihm die tatsächliche Zusammensetzung des Materials bekannt gewesen wäre.
Diese betrügerischen Machenschaften – die sowohl die Qualifizierung der Legierungen als auch die Anwendung von Abzügen betraf – wurden anonym der Personalabteilung zur Anzeige gebracht. Zwar war der Hinweisgeber nicht bekannt, dies hielt das Unternehmen jedoch nicht davon ab, selbst eine interne Untersuchung einzuleiten, um die Wahrhaftigkeit der angezeigten Tatsachen zu prüfen. Diese Untersuchung bestätigte schließlich die angezeigten Tatsachen und bildete den Ausgangspunkt der strafrechtlichen Klage gegen die kompromittierten Angestellten.
Mit diesem Urteil verleiht der oberste Gerichtshof anonymen Anzeigen innerhalb eines Unternehmens volle Gültigkeit und Legitimität. In dem vorliegenden Fall liegt dies daran, dass sich die Ereignisse zutrugen, bevor das Unternehmen über ein internes Compliance-Programm oder Meldekanäle (auch Whistleblower-System genannt) verfügte. Diese internen Systeme werden bald Teil der meisten Unternehmen sein, da im Oktober 2019 eine diesbezügliche EU-Richtlinie verabschiedet wurde. Zum einen schützt diese Richtlinie diejenigen, die Hinweise auf diese internen Verstöße geben, die ihnen innerhalb des Unternehmens zur Kenntnis gelangen könnten. Zum anderen verpflichtet sie in den Mitgliedsstaaten ansässige Unternehmen mit 50 oder mehr Mitarbeitern, solche Whistleblower-Systeme einzuführen.

[value] => En este caso, el Tribunal Supremo ha dictado una sentencia por la que confirma las condenas a dos años de prisión y al pago de 456.340'27 euros y de 340.650'66 euros como indemnización a varios trabajadores de una empresa por la comisión de un delito de estafa.
En concreto, la sentencia declaró que los trabajadores de una empresa dedicada a la adquisición de material de chatarra para su posterior transformación en acero se pusieron de acuerdo con diversos proveedores para recibir de éstos chatarra mezclada con “estériles”, es decir, con materiales de desecho no reciclables, en unos porcentajes muy superiores a los habituales en ese sector.
Así, al recibir la carga de chatarra de los referidos proveedores, los trabajadores de la empresa encargados de clasificar la chatarra por categorías y de determinar el porcentaje de descuento, que se fija en función del porcentaje de “estériles” existente y mezclado con la chatarra útil, aplicaron descuentos muy inferiores a los que realmente debían de haberse aplicado según ese porcentaje. En definitiva, los trabajadores condenados lograron que la empresa que adquirió la chatarra de los proveedores, con quienes habían actuado en conveniencia, pagara por esta chatarra mezclada un precio más alto al que realmente correspondía, de haber conocido la empresa el porcentaje real de “estériles” existente en la chatarra adquirida.
Las citadas maniobras de carácter fraudulento realizadas tanto en la clasificación de la chatarra como en la errónea aplicación de los descuentos fueron denunciadas de manera anónima a través del departamento de recursos humanos. Denuncia, cuyo autor era desconocido, si bien ello no impidió que la propia empresa iniciara una investigación interna para averiguar la veracidad de los hechos denunciados. Investigación que finalmente confirmó los hechos inicialmente denunciados y sirvió para el inicio de las correspondientes acciones penales frente a los trabajadores implicados.
Con esta sentencia, el Tribunal Supremo da plena validez y legitimidad a aquellas denuncias efectuadas con carácter anónimo en el seno de una empresa. En este supuesto, lo hace porque cuando se sucedieron los hechos la empresa todavía no contaba con un programa de cumplimiento normativo interno y tampoco con un 'canal de denuncias interno', denominado “whistleblowing”. Este tipo de instrumentos internos de denuncias estarán pronto presentes en la mayoría de empresas, puesto que en octubre de 2019 se dictó una Directiva europea que regula la materia. Primero, mediante la protección a las personas que denuncien aquellas irregularidades internas de las que pudieran ser conocedoras dentro de las empresas y, segundo, mediante la específica obligación a las compañías de 50 o más trabajadores de los Estados miembros para que implanten este tipo de canales internos de denuncias.
