[value] => Als die Referenzzinssätze für variable Hypothekendarlehen stark zu sinken begannen, entstand die Problematik der sogenannten Mindeszinssatzklauseln. Viele Verbraucher stellten plötzlich fest, dass ihre Hypothekendarlehen die erwähnten Klauseln enthielten, in welchen ein bestimmter Zinssatz vereinbart wurde, den die Bank anwenden konnte, falls der Referenzzinssatz unter den vereinbarten Zinssatz (2 % oder 3 %) sank. Man begann die Klauseln in Frage zu stellen, erst recht bei negativem Euribor.
Das Tribunal Supremo (Oberster Gerichtshof), stellte in seinem Urteil vom 9. Mai 2013 fest, daß die genannten Klauseln missbräuchlich und infolgedessen nichtig sind, da die Verbraucher von den Bankinstituten nicht angemessen über die rechtlichen und wirtschaftlichen Konsequenzen derselben informiert worden waren. Allerdings beschränkte es die Wirkungen der Nichtigkeitserklärung auf die nach dem Urteilsdatum (Mai 2013) rechtsgrundlos geleisteten Beträge.
Der Europäische Gerichtshof hat diese zeitliche Beschränkung jedoch aufgehoben, da sie darauf hinausläuft, daß generell jedem Verbraucher, der vor dem Urteilsdatum einen Hypothekendarlehensvertrag geschlossen hat, der Anspruch genommen wird, eine vollständige Rückerstattung der Beträge zu erhalten, die er vor dem genannten Datum rechtsgrundlos gezahlt hat. Somit werden die Banken alle ab Beginn des Hypothekendarlehens rechtsgrundlos an sie gezahlten Beträge rückerstatten müssen.
Die Entscheidung betrifft rund 1,5 Millionen Personen und der zu erstattende Betrag beläuft sich schätzungsweise auf 2 bis 3 Milliarden Euro. Deswegen hat die spanische Regierung im Einvernehmen mit den Bankinstituten einen Mechanismus zur außergerichtlichen Geltendmachung der Rückerstattungsansprüche geschaffen, um die sowieso schon überlasteten Gerichte nicht noch mehr zu strapazieren. Es bleibt abzuwarten, ob der erwähnte Mechanismus die Verbraucherrechte gebührend berücksichtigt.

[value] => La problemática de las llamadas “cláusulas suelo” contenidas en las hipotecas comenzó cuando los tipos de interés de referencia para los préstamos hipotecarios variables comenzaron a descender de forma vertiginosa. En ese momento, muchos consumidores comprobaron que su préstamo hipotecario contenía la citada cláusula, en virtud de la cual el banco aplicaría un tipo de interés determinado al préstamo cuando el indicador de referencia de la hipoteca fuera inferior a dicho tipo (del 2% o del 3%). Con un Euribor en negativo, la polémica estaba servida.
El Tribunal Supremo, en su sentencia de 9/5/2013, consideró que las citadas cláusulas eran abusivas, y por lo tanto nulas, ya que los consumidores no habían sido informados de forma adecuada por las entidades bancarias acerca de las consecuencias jurídicas y económicas de dicha regulación. De una forma cuestionable, sin embargo, limitó los efectos de esa declaración de nulidad, de forma que sólo surtiría efectos a partir de la fecha de la sentencia (mayo de 2013).
Planteado el oportuno recurso ante el Tribunal de Justicia de la UE, éste, con más coherencia técnico-jurídica, elimina el límite temporal establecido por el TS español. La limitación, según el TJUE, priva a los consumidores españoles que celebraron un contrato con anterioridad a la fecha de la sentencia a ver restituidas las cantidades pagadas indebidamente. Por lo tanto, las entidades bancarias se verán obligadas a reintegrar la totalidad del importe abonado de más desde el inicio de cada préstamo y no únicamente desde el 9/5/2013.
Se calcula que la resolución afecta a unos 1,5 millones de personas y que el importe a devolver por los bancos será de entre 2.000 y 3.000 millones de Euros. De ahí que Gobierno y entidades bancarias hayan acordado establecer un mecanismo de reclamación extrajudicial, que evite una (aún mayor) saturación de nuestros juzgados. Está por ver, sin embargo, si ese mecanismo respeta debidamente los derechos de los consumidores afectados.
