[value] => Die EU-Kommission hat einen Reformvorschlag zur Entsenderichtlinie (RL 96/71/ EG) vorgestellt. Die RL 2014/67/EU war bis zum 18.06.2016 von den einzelnen Mitgliedstaaten umzusetzen. Grund für das Reformvorhaben war zum einen der Anstieg von Arbeitnehmerentsendungen in der EU zwischen 2010 und 2014 um fast 45 Prozent. Zum anderen war das Ziel, den Arbeitnehmerschutz wesentlich zu verbessern. Die neue Richtlinie sollte gewährleisten, dass die jeweiligen Arbeitsbedingungen des jeweiligen Arbeitnehmers in der gesamten EU geschützt sind, um sogenanntes „Sozialdumping“, d.h. das Unterbieten von Löhnen auf Märkten von Dienstleistern, deren Arbeitsstandards niedriger sind, zu vermeiden. Der Reformvorschlag sah weiterhin vor, dass für innerhalb der EU entsandte Arbeitnehmer, und lokale Arbeitnehmer die gleichen Vergütungsvorschriften inklusive Boni und Zulagen gelten.
Allerdings sollen nach der neuen Richtlinie die Arbeitnehmerschutzvorschriften des Aufnahmemitgliedsstaates erst in vollem Umfang gelten, wenn eine langfristige Entsendung von über zwei Jahren stattfindet. Dabei ist immer derjenigen Vorschriften Anwendungsvorrang zu gewähren, die den Arbeitnehmer begünstigt. Um die Ziele der Reform zu erreichen wurde auch der Entsendebegriff präzisiert. Das Entsendeunternehmen muss nun im Herkunftsland eine wesentliche Geschäftstätigkeit entfalten, die Entsendung darf nur noch für einen begrenzten Zeitraum erfolgen und die Kontrollbefugnisse der Behörden sollen vereinheitlicht werden.
Die Reform ist teilweise auf Kritik gestoßen. Einige nationale Parlamente haben sich gegen die Reformpläne der EU-Kommission in Bezug auf den Kampf gegen das Lohndumping ausgesprochen. Andere kritisierten, der Entwurf enthalte zu blumige Formulierungen, die keine Rechtssicherheit bieten. Deutschland hat in seinem Arbeitnehmerentsendegesetz die EU-rechtlichen Vorgaben umgesetzt.
Ob die dargelegten Änderungen zu einem besseren Arbeitnehmerschutz, mehr Transparenz und größerer Rechtsklarheit in den einzelnen Mitgliedstaaten führen, bleibt abzuwarten.

[value] => La Comisión Europea presentó una propuesta de reforma de la Directiva 96/71/CE sobre el desplazamiento de trabajadores. El plazo de transposición de la Directiva 2014/67/UE en los Estados miembros concluyó el 18/06/2016. Los motivos de esta propuesta de reforma fueron, por un lado, el aumento en casi un 45% de los desplazamientos de trabajadores dentro de la UE entre 2010 y 2014 y, por otro, el objetivo de mejorar fundamentalmente la protección de los trabajadores. La nueva Directiva debe garantizar la protección de las condiciones laborales en toda la Unión Europea, evitando el denominado “dumping social”, es decir, que proveedores de servicios ofrezcan salarios más bajos en mercados donde las normas laborales son menos favorables para el trabajador. La propuesta de reforma prevé además la aplicación de un mismo régimen retributivo, incluidos bonus y complementos, tanto a los trabajadores locales como desplazados dentro de la UE.
Sin embargo, de conformidad con la nueva Directiva, las disposiciones sobre protección de los trabajadores del Estado miembro de acogida sólo se aplicarán en caso de desplazamiento de larga duración, es decir, superior a dos años. Se aplican preferentemente las disposiciones que más favorecen al trabajador desplazado. Para lograr los objetivos que plantea la reforma también se ha precisado el concepto del “desplazado”. La empresa que desplaza al trabajador debe desarrollar una actividad sustancial en el país de origen, los desplazamientos se permiten solo durante un periodo limitado y las facultades de control de las administraciones deben unificarse.
La reforma ha sido en parte criticada. Algunos parlamentos nacionales se han expresado en contra de los planes de reforma de la Comisión Europea en lo que respecta a la lucha contra el “dumping social“. Otros criticaron que el proyecto contenía formulaciones demasiado retóricas que no ofrecen seguridad jurídica. Alemania ha transpuesto ya las disposiciones de esta Directiva en su normativa sobre desplazamiento de trabajadores.
Está por ver si estos cambios contribuirán a mejorar la protección de los trabajadores, la transparencia y la claridad jurídica en los Estados miembros.
