[value] => Die deutschen Vergabestellen des Bundes, der Länder und der Kommunen geben ca. 400 Milliarden Euro für die öffentliche Beschaffung von Dienstleistungen und Gütern aus. Die wichtige Rolle der öffentlichen Auftragsvergabe spiegelt sich in der Vergaberechtsreform 2016 wieder. Zweck der Reform ist u.a., die Beteiligung kleiner und mittlerer Unternehmen an öffentlichen Aufträgen zu erleichtern.
Erstmalig sind die Grundsätze der Wirtschaftlichkeit und Verhältnismäßigkeit künftig auf allen Stufen des Vergabeverfahrens und nicht nur bei Eignung und Zuschlagserteilung, zu wahren. Mit dem Gebot der Losaufteilung sollen die mittelständischen Interessen Berücksichtigung finden. Weiter wird das Vergabeverfahren künftig weitgehend elektronisch abgewickelt. Ab dem 18.10.18 sind alle Angebote elektronisch einzureichen. Die Korrespondenz erfolgt elektronisch. Bau- und Dienstleistungskonzessionen sind vergaberechtlich ausschreibungspflichtig und werden durch das neue Vergaberecht einem eigenen Regelwerk unterworfen.
Inhaltlich birgt die Vergaberechtsreform Verfahrenserleichterungen und ein Mehr an Gestaltungsspielraum. Positiv ist die durch Einführung der elektronischen Kommunikation angestrebte Vereinfachung.
Für kleine und mittlere Unternehmen dürfte die Reform allerdings einen erhöhten Organisationsaufwand mit sich bringen, der ohne eine fachkundige Beratung kaum zu leisten ist. Die Gewährleistung mittelstandsfreundlicher Vergaben dürfte durch das Gebot der Teillosvergabe nicht erreicht werden, solange die Losbildung nicht zwingend ausgestaltet ist und die von der Rechtsprechung zugelassenen Ausnahmen weiterhin in der Praxis Anwendung finden.

[value] => Los organismos adjudicadores alemanes, tanto federales como de los estados federados o municipales, desembolsan cerca de 400 000 millones de euros en la licitación de bienes y servicios. El papel fundamental de la contratación pública se refleja en la reforma de la normativa a este respecto de 2016, cuyo objetivo es, entre otras cuestiones, facilitar la participación de pequeñas y medianas empresas en los contratos públicos.
En primer lugar, ahora deberán garantizarse los principios de eficiencia económica y proporcionalidad en todas las fases del proceso de contratación, y no solo a la hora de valorar la aptitud y proceder a la adjudicación. El imperativo de la división por lotes pretende tener en consideración los intereses de las pymes y empresas intermedias. Además, el proceso de contratación se tramitará en el futuro, en su mayor parte, de forma electrónica: a partir del 18 de octubre de 2018, todas las ofertas deberán presentarse de forma electrónica y la correspondencia también se efectuará por ese medio. Las concesiones de obras y prestaciones de servicios están obligadas a someterse a procesos de adjudicación de conformidad con el Derecho de contratación pública y, con la nueva regulación, estarán sujetas a una normativa propia.
En cuanto a su contenido, la reforma del Derecho de contratación pública comprende una simplificación de los procesos y más margen para la elaboración de proyectos. La simplificación que se pretende con la introducción de las comunicaciones electrónicas es un factor positivo.
Sin embargo, para las pequeñas y medianas empresas la reforma podría suponer un mayor esfuerzo organizativo que, sin un asesoramiento especializado, difícilmente podrá llevarse a cabo. La imposición de la distribución en lotes parciales no podrá garantizar una adjudicación más favorable para las pymes y empresas intermedias mientras la formación de dichos lotes no se configure de forma obligatoria y las excepciones permitidas por la jurisprudencia sigan teniendo aplicación en la práctica.
