[value] => Gemäß § 14 Abs. 2 Satz 2 UStG gilt als - zum Vorsteuerabzug berechtigende - Rechnung auch eine Gutschrift, mit der ein Unternehmer über eine steuerpflichtige Lieferung oder sonstige Leistung abrechnet, die an ihn ausgeführt wird. Eine Gutschrift ist anzuerkennen, wenn folgende Voraussetzungen vorliegen:
(1) Der leistende Unternehmer (Empfänger der Gutschrift) muss zum gesonderten Ausweis der Steuer in einer Rechnung berechtigt sein.
(2) Zwischen dem Aussteller und dem Empfänger der Gutschrift muss Einverständnis darüber bestehen, dass mit einer Gutschrift über die Lieferung oder sonstige Leistung abgerechnet wird.
(3) Die Gutschrift muss die Angaben enthalten, die allgemein für Rechnungen gelten.
(4) Die Gutschrift muss dem leistenden Unternehmer zugeleitet worden sein.
(5) Der Empfänger darf der Gutschrift nicht widersprochen haben, da diese sonst die Wirkung einer Rechnung verliert.
Werden, beispielsweise im Rahmen einer steuerlichen Betriebsprüfung, Fehler bei der Ausstellung einer Gutschrift festgestellt, so lässt § 31 Abs. 5 UStDV eine Berichtigung zu.
In einem jüngst veröffentlichten Urteil vom 05.11.2014 (3 K 3209/11) hatte das Finanzgericht München über die Frage zu entscheiden, welche zeitlichen Grenzen für die Ausübung des Widerspruchsrechts und die Berichtigung einer Gutschrift gelten, das das Umsatzsteuergesetz hierfür keine Regelung enthält. Hiernach gilt primär die gesetzliche Verjährung von 3 Jahren. Darüber hinaus ist kann jedoch auch das Rechtsinstitut der Verwirkung einer Berichtigung entgegenstehen, wenn der zum Widerspruch oder zur Berichtigung Berechtigte durch sein Verhalten bei seinem Geschäftspartner bei objektiver Betrachtung den Eindruck erweckt hat, dass dieser nach Ablauf einer gewissen Zeit bei objektiver Betrachtung darauf vertrauen durfte, dass der Anspruch nicht mehr geltend gemacht werden würde, so dass die Rechtsausübung gegen den Grundsatz Treu und Glauben verstoßen würde.

[value] => Según art. 14 (2) frase 2 LIVA alemana se considera coma factura - que da derecho a la deducción del IVA soportado – también la que fue emitida por el destinatario de una operación sujeta, cuando se es empresario o profesional en el sentido de la normativa del IVA alemán. Una factura emitida por el destinatario será reconocida bajo las siguientes condiciones:
(1) El empresario o profesional que realiza la operación (receptor de la factura emitida por el destinatario) tiene el derecho a la repercusión del IVA en facturas.
(2) El emisor y el receptor de la factura estarán de acuerdo que la operación sujeta será liquidada por una factura emitida por el destinatario.
(3) La factura emitida por el destinatario debe contener todos los datos reglamentados para facturas en general.
(4) La factura emitida por el destinatario debe ser entregada al empresario o profesional que ha realizado la operación sujeta.
(5) El receptor no debe haberla rechazado pues pierde su validez bajo la normativa vigente en caso de reclamación.
Si se detectan defectos en facturas emitidas por el destinatario, por ej. en ocasión de una inspección fiscal, el art. 31 (5) RIVA alemán permite una rectificación bajo ciertas condiciones.
En una sentencia recién publicada del 05/11/2014 (3 K 3209/11) el Tribunal de lo Fiscal de Múnich determina el límite temporal para efectuar su reclamo, y rectificarla, dado que la normativa alemana del IVA no contiene reglamentación al respecto. Según la sentencia se aplica la prescripción general de 3 años. En más también el concepto legal del Instituto de la Caducidad podría conducir a una reclamación o rectificación, si el titular del derecho de reclamación o rectificación ha creado la impresión a través de su actuación de que la contraparte tras el vencimiento de un periodo determinado - bajo una perspectiva objetiva – podría confiar en que no se llegaría a invocar el derecho de reclamación o rectificación, entonces con el ejercicio del derecho violaría el principio de la buena fe.
