[value] => Am vergangenen 27.09. sind die Leitlinien der Europäischen Kommission zur Auslegung und Anwendung der Richtlinie 93/13/EWG des Rates über missbräuchliche Klauseln in Verbraucherverträgen veröffentlicht worden.
Die erwähnte Richtlinie hat sich als grundlegender Bestandteil des Gemeinschaftsrechts erwiesen und sie hat als Rechtsgrundlage gedient in einer Reihe von Angelegenheiten, die in unserer jüngsten Rechtsprechung von großer Bedeutung gewesen sind, insbesondere in Bezug auf die Beziehung zwischen Verbraucher und Banken (z.B. Mindestzinssatzklauseln, vorzeitige Fälligkeit von Hypotheken, Vermarktung zweifelhafter Bankprodukte usw.).
Nach einer kürzlich erfolgten regulatorischen Anpassung der Richtlinie und auch mit dem Ziel, die vom EuGH in den letzten 26 Jahren diesbezüglich erlassene Rechtsprechung zusammenzufassen, hat die Kommission diese Leitlinien zur Auslegung herausgegeben, die ihren Ursprung in der Mitteilung mit dem Titel „Neugestaltung der Rahmenbedingungen für die Verbraucher“ vom 11.04.2018 haben, in der die genannten Leitlinien erstmals angekündigt wurden.
Wie in der Einleitung beschrieben, befasst sich Abschnitt 1 mit den Zielen und dem Anwendungsbereich der Richtlinie, Abschnitt 2 bezieht sich auf den Grundsatz der Mindestharmonisierung und das Verhältnis zum nationalen Recht im Allgemeinen, Abschnitt 3 analysiert die Beurteilung der Transparenz sowie fairer bzw. missbräuchlicher Vertragsklauseln, Abschnitt 4 erläutert die Folgen der Missbräuchlichkeit von Vertragsklauseln in Bezug auf die Rechte und Pflichten der Parteien, Abschnitt 5 behandelt im Detail die Verfahrensvoraussetzungen für die Bewertung von Vertragsklauseln, einschließlich der Verpflichtung der nationalen Gerichte, eine aktive Rolle bei der Beurteilung von Vertragsklauseln zu übernehmen, und in Abschnitt 6 werden schlieβlich einige Besonderheiten von Unterlassungsverfahren erörtert.
Unserer Meinung nach handelt es sich um ein effektives Instrument, das zweifellos zur korrekten Anwendung dieser wichtigen Norm des Gemeinschaftsrechts beitragen wird.

[value] => El pasado 27 de septiembre se publicó la Comunicación de la Comisión Europea, relativa a la interpretación y la aplicación de la Directiva 93/13/CEE del Consejo sobre las cláusulas abusivas en los contratos con los consumidores.
La citada Directiva ha resultado ser una pieza fundamental en el ámbito comunitario y ha servido de fundamentación jurídica en no pocos asuntos que han sido muy relevantes en nuestra jurisprudencia más reciente, especialmente en lo que se refiere a las relaciones de los consumidores con las entidades bancarias (así, por ejemplo, en los asuntos relativos a las cláusulas suelo de las hipotecas, al vencimiento anticipado de las mismas, a la contratación de productos bancarios dudosos, etc.).
Tras una reciente adecuación normativa de la Directiva y con el fin también de sintetizar la jurisprudencia que al amparo de la misma se ha dictado por el TJUE en los últimos 26 años, la Comisión ha elaborado esta guía para su interpretación, que tiene su origen en la Comunicación de la Comisión «Un Nuevo Marco para los Consumidores» de 11 de abril de 2018, en la que la citada guía se anunció por primera vez.
Según describe su introducción, en la sección 1ª se abordan los objetivos y el ámbito de aplicación de la Directiva, la 2ª hace referencia al principio de armonización mínima y la relación con el Derecho nacional en general, la 3ª analiza la evaluación de la transparencia y el carácter abusivo o no de las cláusulas contractuales, la 4ª aclara las consecuencias del carácter abusivo de las cláusulas contractuales con respecto a los derechos y las obligaciones de las partes, la 5ª cubre en detalle los requisitos procesales para la evaluación de las cláusulas contractuales, incluida la obligación de los órganos jurisdiccionales nacionales de desempeñar un papel activo en la evaluación del contrato y, por último, la 6ª comenta algunas particularidades de las acciones de cesación.
Se trata, en nuestra opinión, de una herramienta eficaz que ayudará sin duda en la correcta aplicación de esta importante norma comunitaria.
