[value] => Im Zuge der Globalisierung und der internationalen Wettbewerbsfähigkeit verlangen Unternehmen immer öfter, dass ihre Mitarbeiter vorübergehend im Ausland tätig werden. Dabei vertreten viele Unternehmen die Ansicht, dass ihre Mitarbeiter automatisch einer internationalen Entsendung nachkommen müssen, soweit technische, wirtschaftliche, produktive oder organisatorische Gründe vorliegen, die eine solche Entsendung rechtfertigen.
Früher ging die Rechtsprechung in vielen Fällen davon aus, dass ein Arbeitnehmer die vorübergehende Tätigkeit im Ausland verweigern könne, da Artikel 40 des Arbeitnehmerstatuts, der die geografische Mobilität regelt, diese internationale Mobilität nicht ausdrücklich vorsieht.
In neueren Urteilen vertreten die spanischen Gerichte jedoch die Auffassung, dass die Arbeitnehmer verpflichtet sind, die internationale Entsendeanordnung des Arbeitgebers einzuhalten, wobei sie diese jedoch in jedem Fall anfechten können, damit die Sozialgerichtsbarkeit die Rechtfertigung der Entsendung aus wirtschaftlichen, technischen, organisatorischen oder produktiven Gründen überprüft. Ebenso kann der Arbeitnehmer die gerichtliche Beendigung des Arbeitsvertrags mit entsprechender Abfindung verlangen, wenn die Entsendung eine Beeinträchtigung seiner Würde mit sich bringt.
Um die Möglichkeit einer internationalen Entsendung zu gewährleisten, nehmen viele Unternehmen in ihre Arbeitsverträge eine internationale Mobilitätsklausel auf, in der der Arbeitnehmer im Voraus einer solchen Mobilität zustimmt, was die unternehmerische Anordnung stärkt, obwohl die Klausel nicht als einseitige und willkürliche Befugnis verstanden werden darf, die keiner Rechtfertigung seitens des Arbeitgebers bedarf. Was aber passiert, wenn ein Arbeitnehmer sich weigert, eine gerechtfertigte internationale Entsendeanordnung zu befolgen? Das Unternehmen kann den Arbeitnehmer als Folge seiner Weigerung sanktionieren, gegebenenfalls sogar mit einer Disziplinarkündigung, wobei immer die Besonderheiten des Einzelfalls zu berücksichtigen sind.

[value] => Como consecuencia de la globalización y la competitividad internacional, cada vez es más frecuente que las empresas requieran que sus trabajadores presten temporalmente sus servicios en el extranjero. Es por ello que muchas empresas se plantean que sus trabajadores cumplan de manera automática la orden de desplazamiento internacional, siempre y cuando existan razones de índole técnica, económica, productiva u organizativa que justifiquen ese desplazamiento.
Anteriormente, la jurisprudencia entendía en muchos casos que un trabajador podía negarse a trabajar temporalmente en el extranjero, porque el artículo 40 del ET, que se refiere a la movilidad geográfica, no regula expresamente la movilidad internacional.
No obstante, en sentencias más recientes, nuestros Tribunales consideran que los trabajadores sí están obligados a cumplir la orden de desplazamiento internacional del empresario, pudiendo, en todo caso, impugnarla cuando no estén conformes para que la jurisdicción social revise la justificación de la orden de desplazamiento por razones económicas, técnicas, organizativas o de producción. Asimismo, el trabajador puede solicitar la extinción judicial del contrato de trabajo con la correspondiente indemnización en caso de que el desplazamiento suponga un menoscabo a su dignidad.
Para garantizar la posibilidad de un desplazamiento internacional, muchas empresas incluyen en sus contratos laborales una cláusula de movilidad internacional en la cual el empleado da de forma anticipada su conformidad a dicha movilidad, lo que fortifica la orden empresarial, aunque la cláusula no debe ser entendida como una facultad unilateral y discrecional que no requiera una justificación por parte del empresario. Pero, ¿y si un trabajador se niega a cumplir una orden justificada de desplazamiento internacional? Frente a su negativa, la empresa puede sancionar al trabajador, incluso con su despido disciplinario, aunque para ello habría que atender siempre a las peculiaridades de cada caso concreto.
