[value] => Mit Urteil vom 23.01.2019 hat das Bundesarbeitsgericht (BAG) seine bisherige Rechtsprechung in Bezug auf die sachgrundlose Befristung von Arbeitsverträgen aufgegeben. Es verabschiedet sich von der Befristung des Vorbeschäftigungsverbots auf einen Zeitraum von drei Jahren.
Damit folgen die BAG-Richter einer Entscheidung des Bundesverfassungsgerichts (BVerfG) vom letzten Jahr, nach der diese Interpretation des §14 Teilzeit- und Befristungsgesetz (TzBfG) verfassungswidrig und somit unzulässig sei, da der Gesetzgeber eine solche Befristung erkennbar nicht gewollt und die klare Intention gehabt habe, Kettenbefristungen zu vermeiden. Nach dem Wortlaut des Gesetzes ist eine sachgrundlose Befristung bis zu zwei Jahren möglich, wenn nicht „mit demselben Arbeitgeber bereits zuvor ein befristetes oder unbefristetes Arbeitsverhältnis bestanden hat“.
Nach der Rechtsprechung des BVerfG obliegt es den Fachgerichten, in verfassungskonformer Auslegung der Norm eine Einschränkung vorzunehmen: Demzufolge kann das aus der Regelung resultierende Verbot der sachgrundlosen Befristung im Einzelfall unzumutbar sein, wenn die Vorbeschäftigung beim Arbeitgeber sehr lang zurückliegt, ganz anders geartet war oder von sehr kurzer Dauer gewesen ist.
Im vorliegenden Verfahren hat das BAG in der Konsequenz ein Arbeitsverhältnis, das acht Jahre vor der erneuten Beschäftigung für eineinhalb Jahre mit einem vergleichbaren Aufgabenfeld bestanden hatte, als „nicht sehr lang“ zurückliegend eingeordnet und die sachgrundlose Befristung in diesem Fall für unzulässig erklärt. Die Klage des Arbeitnehmers auf Feststellung, dass das Arbeitsverhältnis mit Ablauf der Befristung nicht geendet hat, hatte somit Erfolg. Der beklagte Arbeitgeber konnte sich auch nicht auf Vertrauensschutz hinsichtlich der zum Zeitpunkt der Befristung (Zeitraum 2013 bis 2015) geltenden Rechtsprechung des BAG berufen. So habe er nicht darauf vertrauen dürfen, dass die damalige verfassungskonforme Auslegung der Norm vor dem BVerfG Bestand haben werde.

[value] => En su sentencia del 23.01.2019 el Tribunal Federal de Trabajo (BAG) ha modificado su jurisprudencia anterior sobre la posibilidad de celebrar contratos temporales sin causa objetiva.
En este respecto, desiste en su interpretación de la ley alemana, la cual preveía que las relaciones laborales precedentes a un nuevo contrato temporal se tuvieran solamente en cuenta cuando hubieran terminado en un plazo de tres años antes de la contratación nueva. Los jueces del BAG siguieron a la jurisprudencia del Tribunal Constitucional Federal Alemán (BVerfG) del año pasado cuando declararon inconstitucional ésta interpretación del Art. 14 de la ley Federal que regula el tiempo parcial y relaciones laborales temporales.
El texto oficial de la ley prevé un plazo máximo de dos años para los contratos limitados sin causa, salvo que haya existido una relación laboral previamente. Según establece el Tribunal, la aplicación restringida de la ley no estaba conforme a la voluntad del legislador alemán, que se había expresado claramente en contra de las relaciones laborales encadenadas. Sin embargo, añade que los tribunales de trabajo tienen la obligación de interpretar la norma conforme con la constitución, es decir, en ciertos casos, la prohibición de los contratos laborales temporales sin causa puede resultar inadmisible, especialmente cuando la relación laboral previa fue hace mucho tiempo, el trabajador estuvo ocupado en un campo de actividad diferente o ésta era de corta duración.
En su fallo actual, siguiendo a la jurisprudencia del BVerfG, el BAG ha declarado improcedente un contrato limitado celebrado con un trabajador que había trabajado anteriormente en la empresa durante ocho años y se había ocupado casi de las mismas tareas. En consecuencia, su recurso, con el fin de declarar que la nueva relación laboral no había terminado en el plazo de dos años, tuvo éxito. Según estableció el tribunal, no debió de confiar en que el Tribunal Constitucional no declarara inconstitucional la anterior interpretación de la ley.
