[value] => Die Monate Dezember und Januar rücken näher und mit ihnen die Einstellung von Personal zur Abdeckung von Arbeitsplätzen während Weihnachten und des Winterschlussverkaufs.
Daher greifen viele Unternehmen auf befristete Verträge zurück, um die vorübergehende Zunahme ihrer Aktivitäten aufgrund von Marktgegebenheiten zu bewältigen und der punktuellen Aufgabenhäufung oder dem Überschuss von Aufträgen nachzukommen, und diese werden hauptsächlich in vorübergehenden Momenten genutzt, in denen das Stammpersonal nicht in der Lage ist, die erhöhte Arbeitsbelastung aufzufangen. Die maximale Laufzeit beträgt 6 Monate innerhalb eines Bezugszeitraums von 12 Monaten, wobei beide tarifvertraglich geändert werden können. Wurde der Vertrag für eine kürzere Dauer abgeschlossen, kann er einmal verlängert werden, wobei die Gesamtdauer die genannte maximale Dauer zu respektieren hat. Der Vertrag ist schriftlich zu formalisieren, wenn seine Laufzeit mehr als 4 Wochen beträgt oder wenn es sich um einen Teilzeitvertrag handelt, und im Vertrag sind zwingend die besonderen Gründe anzugeben, die die begrenzte Laufzeit des Vertrags rechtfertigen, ohne dass es ausreicht, nur auf einen der gesetzlichen Sachverhalte zu verweisen.
Befristete Arbeitnehmer haben die gleichen Rechte wie Festangestellte, so dass sie Anspruch auf die tarifvertraglichen und gesetzlichen Ruhezeiten haben. Daher ist es bei der Arbeit an Wochenenden oder Feiertagen notwendig, die Bestimmungen des Tarifvertrages und die darin festgelegte Kompensation einzuhalten. Selbst unter Berücksichtigung der geschäftlichen Notwendigkeit, sich so weit wie möglich an den Bedarf der Kunden anzupassen, muss jede Änderung der Arbeitszeiten aus organisatorischen, technischen, produktiven oder wirtschaftlichen Gründen gerechtfertigt sein. Schließlich hat der Arbeitnehmer bei Vertragsbeendigung infolge Ablaufs der vereinbarten Frist und nach vorheriger Kündigung Anspruch auf eine Abfindung in Höhe von 12 Tagesgehältern pro Dienstjahr.

[value] => Se acercan los meses de diciembre y enero y, con ellos, aumenta la contratación de personal para cubrir puestos de trabajo durante las Navidades y las rebajas. Por eso, muchas empresas recurren a contratos eventuales para hacer frente al aumento coyuntural de su actividad causada por circunstancias de mercado, para atender a la acumulación de tareas puntuales o exceso de pedidos y se emplea principalmente momentos ocasionales y transitorios, cuando la plantilla habitual no puede atender la mayor carga de trabajo.
Su duración máxima es de 6 meses dentro de un periodo de referencia 12, aunque por convenio colectivo pueda modificarse la duración máxima y el período de referencia. Si el contrato ha sido concertado por una duración inferior a la máxima, es posible prorrogarlo por una sola vez, respetando su duración total la duración máxima antes mencionada. El contrato ha de formalizarse por escrito cuando su duración sea superior a 4 semanas o se trate de un contrato a tiempo parcial y es obligatorio indicar en el contrato de forma precisa las causas concretas que justifiquen la limitada duración del contrato, sin que sea suficiente indicar uno de los supuestos previstos en la ley.
Los trabajadores temporales tienen los mismos derechos que los trabajadores indefinidos, por lo que tienen derecho a los descansos previstos por convenio colectivo y por la ley. Como consecuencia, para trabajar en fines de semana o festivos es necesario respetar lo estipulado en el convenio colectivo y la compensación que éste establezca. Aun teniendo en cuenta la necesidad empresarial de ajustarse lo máximo posible al horario de sus clientes, cualquier cambio de horario se tendrá que justificar por causas organizativas, técnicas, productivas o económicas, que exijan tal cambio. Por último, a la finalización del contrato por expiración del plazo pactado y tras previa denuncia, el trabajador tendrá derecho a recibir una indemnización de 12 días por año de servicio.
