[value] => Im Mai 2018 ist das Königliche Dekret 563/2017 über die technischen Unterwegskontrollen von Nutzfahrzeugen in Kraft getreten. Es enthält wichtige Neuigkeiten zum Beladen von Fahrzeugen und zur Ladungssicherung. Bisher gab es kaum eine gesetzliche Vorschrift, die die Ladungssicherung im Innern des LKW’s regelte, und alles hing von der mehr oder weniger großen Erfahrung des Verladers oder des Frachtführers ab.
Das o.e. Königliche Dekret enthält ein neues Regelwerk technischer Vorschriften betreffend die Verladung und Sicherung der Ware, und ein Verstoß gegen diese Vorschriften kann schwere Strafen zur Folge haben, wenn das Fahrzeug, welches die Ware befördert, einer Unterwegskontrolle unterzogen wird, und festgestellt wird, dass die Vorschriften nicht beachtet wurden.
Es stellt sich jedoch die Frage, ob der Frachtführer oder der Verlader/Absender die Strafe zu tragen hat. Wer ist für die Beladung und die Ladungssicherung verantwortlich? Bis vor nicht allzu langer Zeit herrschte die Meinung, dass der Frachtführer die Verantwortung trägt, da er das für die Beförderung eingesetzte Fahrzeug am besten kennt. Das CMR Übereinkommen über die Beförderung im internationalen Straßengüterverkehr sieht jedoch vor, dass der Frachtführer von seiner Haftung befreit ist, wenn der Verlust oder die Beschädigung der Ware aus “Behandlung, Verladen, Verstauen oder Ausladen des Gutes durch den Absender, den Empfänger oder Dritte, die für den Absender oder Empfänger handeln” entstanden ist (Art. 17.4.c). Das spanische Gesetz 15/2009 über den Straßengüter-verkehr enthält seinerseits eine fast wörtliche Wiedergabe des erwähnten Artikels des CMR Übereinkommes.
Eine Anordnung der spanischen Generaldirektion für Verkehr (DGT) (Instrucción 18/TV-103) vom 19.6.2018 lautet wörtlich: “Es wird festgelegt, dass das Verstauen der Güter zu Lasten des Verladers geht, es sei denn, diese Arbeiten wurden ausdrücklich vor Beginn der Beladung vom Frachtführer übernommen.” Alles scheint also darauf hinzudeuten, dass der Absender/Verlader für die Ladungssicherung an Bord des LKW’s verantwortlich ist.

[value] => En mayo de 2018 entró en vigor el Real Decreto 563/2017, por el que se regulan las inspecciones técnicas en carretera de vehículos comerciales, que introduce importantes novedades en la regulación de la estiba y aseguramiento de la mercancía. Hasta ese momento no había prácticamente normativa alguna que regulara cómo debía asegurarse la mercancía transportada dentro de un camión, y todo se dejaba a la mayor o menor experiencia del cargador o del transportista.
El Real Decreto establece un auténtico cuerpo técnico-normativo para realizar el aseguramiento de la mercancía. Y es enormemente relevante, ya que su inobservancia puede dar lugar a importantes sanciones, si el vehículo que transporta la mercancía es objeto de una inspección y se determina que incumple las normas del Real Decreto.
Ahora bien, ¿quién debe ser sancionado, el transportista o el cargador/remitente? ¿Quién es el responsable de la estiba y el aseguramiento de la mercancía en el camión? Hasta no hace mucho tiempo se consideraba que era el transportista el responsable, ya que era en definitiva el que mejor conocía el vehículo usado para el transporte.
El Convenio CMR, sin embargo, prevé que el transportista está exonerado de responsabilidad cuando se producen daños causados por la “manipulación, carga, estiba o descarga de la mercancía realizadas por el remitente o el destinatario o personas que obren por cuenta de uno y otra” (art. 17.4.c). Por su parte, el art. 49.1.c de la Ley 15/2009, del contrato de transporte terrestre de mercancías reproduce de una forma casi literal el citado precepto del CMR.
Por último, la Instrucción 18/TV-103, de la DGT, de 19/06/2018, interpretando el Real Decreto citado, dice textualmente que “se establece, con carácter general, que la estiba de las mercancías será por cuenta del cargador, salvo que expresamente se asuman estas operaciones por el porteador antes de la efectiva presentación del vehículo para su carga”.
Todo apunta, por tanto, a que el cargador/remitente es el responsable de asegurar la mercancía en el camión.
