Verfallklausel, nach welcher sämtliche Ansprüche des Arbeitnehmers aus dem Arbeitsverhältnis verfallen, wenn sie nicht innerhalb von drei Monaten schriftlich geltend gemacht werden, ist Standardinhalt in deutschen Arbeitsverträgen. Die neueste Entscheidung des Bundesarbeitsgerichts (BAG, Urteil v. 18.09.2018, Az: 9 AZR 162/18) könnte jedoch für viele Arbeitgeber ein böses Erwachen zur Folge haben. Denn eine Verfallsklausel ist dem höchsten deutschen Arbeitsgericht zufolge immer dann unwirksam, wenn der Anspruch auf den Mindestlohn nicht explizit vom Verfall ausgenommen ist. Dies gilt jedenfalls dann, wenn der Arbeitsvertrag nach dem 31.12.2014 geschlossen wurde. Da im Falle der Nichtigkeit die gesamte Klausel von der Unwirksamkeit erfasst wird, könnten Arbeitnehmer in der Folge auch andere Ansprüche z.B. auf Spesen oder Urlaub noch nachträglich geltend machen, weil ja keine Verfallsklausel wirksam besteht.
Im Beispiel des der Entscheidung zugrundeliegenden Falles war der Kläger bei dem Beklagten seit dem 01.09.2015 als Fußbodenleger beschäftigt gewesen. Im Arbeitsvertrag war geregelt, dass alle beidseitigen Ansprüche aus dem Arbeitsverhältnis verfallen, wenn sie nicht innerhalb von drei Monaten gegenüber der anderen Vertragspartei schriftlich geltend gemacht würden. Nach Beendigung des Arbeitsverhältnisses machte der Kläger noch nicht abgegoltenen Urlaub geltend. Dem widersprach der Beklagte unter Berufung auf die Verfallklausel. Der Kläger habe den Urlaubsanspruch zu spät geltend gemacht.
Das Bundesarbeitsgericht gab dem Kläger recht. Da die Klausel auch den gem. § 3 Mindestlohngesetz unabdingbaren Anspruch auf Mindestlohn miteinschließe, sei sie unverständlich und verstoße damit gegen das in § 307 Abs. 1 Satz 2 BGB festgelegte Transparenzgebot. Dies habe die komplette Unwirksamkeit der Klausel zur Folge, womit der Kläger auch noch nach drei Monaten seinen Urlaubsanspruch geltend machen konnte.

Sin embargo, la última decisión del Tribunal Federal del Trabajo (TFT) podría provocar un desagradable despertar para muchos empleadores.
El más alto tribunal laboral alemán dictaminó que tal cláusula sólo era lícita si excluye de forma expresa el derecho del empleado a percibir el salario mínimo (el derecho a reclamar el salario mínimo no está sujeto a prescripción). La invalidez de la cláusula afecta a su totalidad por no mencionar la excepción del salario mínimo.
Según el TFT, la cláusula completa se considera nula si no se tiene en cuenta el salario mínimo. Los empleados pueden entonces hacer valer todas las reclamaciones, incluso después de tres meses.
La sentencia se basa en que un empleado demandó a su empresa donde había sido contratado como solador desde el 01.09.2015. El contrato de trabajo estipulaba que todos los derechos mutuos derivados de la relación laboral caducaban, si no se reclamaban por escrito, contra la otra parte en el plazo de tres meses. Tras la terminación de la relación laboral, el demandante reclamó una recompensa por las vacaciones que aún no había disfrutado. El demandado, refiriéndose a la cláusula de caducidad argumentó que el trabajador había presentado su reclamación demasiado tarde.
El Tribunal Federal de Trabajo falló a favor del empleado. Dado que la cláusula general de prescripción no excluía la especial prescripción del derecho al salario mínimo, requerido según el artículo 3 de la Ley del salario mínimo, toda la cláusula resultó inválida. Aparte de esto, por no cumplir la cláusula con el requisito de transparencia establecido en el art. 307 Código Civil se confirmó la nulidad de la cláusula, por lo que el demandante pudo reclamar su derecho a vacaciones después de tres meses.
