[value] => In seinem Urteil letzten November stärkte der spanische Oberste Gerichtshof (Tribunal Supremo) die Rechte von Fluggästen, da er mehrere Klauseln der Verträge einer Fluggesellschaft für nichtig erklärte, denn seiner Auffassung nach widersprechen diese dem vertraglichen Treu und Glauben und seien mehrdeutig.
Erstens wird die Klausel als nichtig angesehen, die es der Fluggesellschaft erlaubt, einen Flug zu stornieren, wenn der Fluggast sein Ticket für Hin-und Rückflug nur für einen der beiden Flüge verwendet. Der Gerichtshof begründete seine Entscheidung damit, dass „die fragliche Klausel ein Ungleichgewicht der Rechte und Pflichten gegen Treu und Glauben darstellt, da dem Verbraucher, der seine Pflicht, einzig die Zahlung des Preises, erfüllt hat, die Nutzung der gesamten vertraglich vereinbarten Leistungen in jedem Fall abgesprochen wird, der aus Gründen, die sehr unterschiedlicher Natur sein können, entschieden hat, die Leistung nicht voll in Anspruch zu nehmen, oder dem es nicht möglich war."
Zweitens erklärte der Oberste Gerichtshof eine Klausel für nichtig, die die Fluggesellschaft befugte, die Beförderungsbedingungen „falls nötig“ („en caso de necesidad“) zu ändern, da dieser Ausdruck zu allgemein und ungenau sei, was möglicherweise Fälle einschließen könnte, die über „außergewöhnliche Umstände“ hinausgehen würden. Dies würde ungerechtfertigterweise den Beförderer von seiner Haftung befreien.
Obgleich seit dem Jahr 2014 eine europäische Verordnung zur Anerkennung der Rechte von Fluggäste in der EU gegenüber Fluggesellschaften bei Verweigerung des Boardings, der Annullierung von Flügen oder massiven Verspätungen existiert, bestätigt dieses Urteil wie in jüngster Zeit, dass es die Gerichte und Gerichtshöfe sind, die jetzt den auf Fluggesellschaften und Fluggäste anwendbaren rechtlichen Rahmen definieren.

[value] => El Tribunal Supremo español en una sentencia del pasado mes de noviembre amplió los derechos de los pasajeros aéreos al declarar la nulidad de varias de las cláusulas de los contratos de una aerolínea por entender que éstas perjudicaban la buena fe contractual y eran ambiguas.
Primero, consideró nula la cláusula que permitía a la compañía aérea cancelar un trayecto para el caso de que un pasajero que hubiera obtenido un billete de ida y vuelta únicamente utilizara uno de los trayectos. El Tribunal justificó su pronunciamiento alegando que: “la cláusula en cuestión supone un desequilibrio de derechos y obligaciones contrario a la buena fe, puesto que a un consumidor que ha cumplido con su obligación, que es únicamente el pago del precio, se le priva en todo caso del disfrute de la prestación contratada, que, por razones que pueden ser de naturaleza muy diversa, ha decidido o se ha visto impedido a disfrutar sólo en parte”.
En segundo lugar, el Tribunal Supremo declaró también la nulidad de una cláusula que facultaba a la compañía aérea a modificar las condiciones del transporte “en caso de necesidad” al entender que esta expresión resultaba excesivamente genérica e imprecisa, lo cual, podía llegar a incluir supuestos que irían más allá de las “circunstancias extraordinarias”, con lo que se estaría excluyendo injustificadamente al transportista de su responsabilidad.
Esta sentencia viene a confirmar cómo en los últimos tiempos, pese a existir ya desde el año 2014 un Reglamento europeo que reconoce los derechos de los pasajeros de la Unión Europea frente a las aerolíneas en caso de denegación de embarque, cancelación o gran retraso, son los Tribunales los que están entrando a definir el marco jurídico aplicable a las compañías aéreas y pasajeros.
