[value] => Das neue Reisevertragsrecht beruht auf der EU-Pauschalreiserichtlinie. Es tritt am 01.07.2018 in Kraft und bringt für Reiseveranstalter eine Reihe von Neuerungen. Die Rechte des Verbrauchers werden hierdurch weiter gestärkt.
Erstmals wird nun im deutschen Gesetz der Begriff der Pauschalreise definiert. Es handelt sich dabei um eine Verbindung von mindestens zwei verschiedenen Reiseleistungen, z.B. Beförderung und Beherbergung oder Vermietung von Kraftfahrzeugen. Eine Pauschalreise liegt nur vor, wenn sie mehr als 24 Stunden dauert und der Reisepreis 500,- Euro übersteigt. Für Geschäftsreisen kann die Anwendung des Pauschalreiserechts ausgeschlossen werden, wenn der Reiseveranstalter und das Unternehmen einen entsprechenden Rahmenvertrag für die Organisation von Geschäftsreisen abschließen.
Die Regelungen zu Reisemängeln sind weitgehend ähnlich wie im alten Recht. Der Reisende muss einen Mangel unverzüglich anzeigen, damit der Reiseveranstalter Abhilfe schaffen kann. Gelingt die Abhilfe nicht, stehen dem Reisenden Ansprüche auf Minderung, Kündigung und ggf. auch Schadensersatz zu. Neu ist für den Reiseveranstalter die Möglichkeit, Schadensersatzansprüche grundsätzlich auf den dreifachen Reisepreis zu begrenzen.
Anders als im früheren Recht muss der Reisende seine Ansprüche nicht mehr innerhalb einer Monatsfrist nach Beendigung der Reise schriftlich geltend machen. Ihm steht hierfür der gesamte Zeitraum der Verjährungsfrist zur Verfügung, die jetzt zwei Jahre beträgt. Der Gesetzgeber hat auch eine Reihe von Bestimmungen aufgenommen, die eine Umgehung des Pauschalreiserechts durch die Vermittlung von einzelnen Reiseleistungen unterbinden sollen.

[value] => La nueva ley de contrato de viaje se basa en la Directiva (UE) relativa a los viajes combinados. Entrará en vigor el 1 de julio de 2018 e introducirá una serie de novedades para los operadores turísticos, quedando los derechos del consumidor aún más reforzados.
Por primera vez ha quedado definido en la legislación alemana el término viaje combinado. Se trata de una combinación de al menos dos servicios diferentes de viaje, p.ej. transporte y alojamiento o alquiler de vehículos. Sólo se considera viaje combinado si dura más de 24 horas y el precio del viaje supera los 500 €. Para los viajes de negocios puede quedar excluida la aplicación de la ley de los viajes combinados si el operador turístico y la empresa celebran el correspondiente acuerdo marco para la organización de los viajes de negocios.
Las disposiciones relativas a las deficiencias de viajes son muy similares a las recogidas en la ley anterior. El viajero debe informar inmediatamente de un defecto para que el operador turístico pueda rectificar la situación. En el supuesto de que no se pueda corregir esta situación, el viajero tendrá derecho a una reducción en el precio, a una cancelación y, en su caso, a una indemnización. La novedad para los operadores turísticos es la posibilidad de limitar el importe de la indemnización a tres veces el precio del viaje.
A diferencia de la ley anterior, el viajero no tiene que realizar una reclamación por escrito en el plazo de un mes desde la terminación del viaje. Para ello contará con todo el período del plazo de preinscripción establecido al efecto, y que ahora es de dos años. El legislador ha integrado una serie de disposiciones al objeto de evitar la elusión de la ley de los viajes combinados mediante la intermediación de servicios individuales de viaje.
