[value] => In den Ausgaben Januar und Juni 2017 dieses Newsletters hatte der Verfasser bereits über verschiedene Fragen zum Vorsteuerabzug im Zusammenhang mit der Berichtigung von Rechnungen berichtet.
In der Rechtssache Volkswagen AG (C-533/16) hat der Europäische Gerichtshof (EuGH) nun in einem jüngst veröffentlichten Urteil vom 21.03.2018 festgestellt, dass (1)zur Ausübung des Rechts auf Vorsteuerabzug in formeller Hinsicht stets der Besitz einer ordnungsmäßigen Rechnung erforderlich ist, (2) ein Vorsteuerabzug in zeitlicher Hinsicht erst dann möglich ist, sobald der Steuerpflichtige im Besitz der Rechnung ist und (3) der Vorsteuerabzug auch dann noch möglich ist, wenn verfahrensrechtlich die steuerlichen Festsetzungsfristen des innerstaatlichen Rechts des betroffenen EU-Mitgliedsstaats bereits abgelaufen sind, soweit kein Missbrauch oder ein sog. kollusives Zusammenwirken der am Leistungsaustausch Beteiligten vorliegen.
Obwohl sich Steuerpflichtige in Deutschland unmittelbar auf dieses Urteil berufen können, dürfte zumindest die Umsetzung des letztgenannten Grundsatzes in Deutschland gegebenenfalls nicht unproblematisch sein. Denn zum einen sind bei der Geltendmachung von Ansprüchen auf Nachzahlung von erstmalig in Rechnung gestellter Umsatzsteuer auch in zivilrechtlicher Hinsicht die Vorschriften über die Verjährung zu berücksichtigen, so dass sich Rechnungsempfänger bei der Geltendmachung von Nachzahlungsansprüchen auf die Einrede der Verjährung berufen können. Zum anderen sieht das innerstaatliche deutsche Steuerverfahrensrecht im (Extrem-)Fall von Steuerhinterziehung eine absolute Festsetzungsfrist von 10 Jahren nach Entstehung der Steuer bzw. nach Ablauf des Kalenderjahrs, vor, in dem die zugrundeliegende Steuererklärung eingereicht wird.
Ob das Urteil den deutschen Gesetzgeber zu Anpassung gesetzlicher Bestimmungen motivieren wird, bleibt abzuwarten, in der Unternehmenspraxis sollte in jedem Fall auf ein effizientes Vertrags- und Forderungsmanagement geachtet werden, um Probleme bereits im Ansatz zu vermeiden.

[value] => En las ediciones de enero y junio de 2017 de este boletín, el autor ya informó sobre varias cuestiones referentes a la deducción del IVA soportado debido a la corrección de facturas.
En el asunto Volkswagen AG (C-533/16), el Tribunal de Justicia de la Unión Europea (TJUE) determinó en una sentencia del 21/03/2018 recién publicada que (1) desde la perspectiva formal, para el ejercicio del derecho a deducción es siempre necesario una factura adecuada, (2) desde la perspectiva temporal es posible la deducción una vez que el obligado tributario tiene la factura y (3) procesalmente, la deducción es también posible cuando los plazos de liquidación del derecho interno del Estado de la UE afectado hayan expirado, en la medida en que no exista un abuso o una cooperación colusiva de los participantes en los intercambios comerciales.
Si bien los obligados tributarios pueden referirse directamente a esta sentencia en Alemania, su puesta en práctica podría plantear problemas en Alemania por lo menos en el último ítem mencionado. Pues, por una parte, en el ejercicio de pretensiones de pago suplementario de IVA facturado por primera vez, desde el punto de vista civil deben tenerse también en cuenta las disposiciones sobre la prescripción, de modo que el receptor de la factura, en el caso del ejercicio de pretensiones de pago suplementario, podría alegar prescripción. Por otra parte, el derecho procesal tributario alemán, en el caso (extremo) de la evasión fiscal, prevé un plazo de liquidación de 10 años desde el devengo del impuesto o bien tras el transcurso del ejercicio en que se presente la declaración de impuestos referente a este último.
Si la sentencia animará al legislador alemán a proceder con la adaptación de las disposiciones legales está por verse, en la práctica empresarial debería prestarse atención en todo caso a una gestión de contratos y de reclamaciones eficiente para evitar este supuesto.
