[value] => Das Internet der Dinge, auch bekannt als Internet of things (IoT) ist ein schnell wachsendes, technologisches Phänomen und bezieht sich auf die Integration von Sensoren und Geräten in Alltagsgegenstände, um eine Verbindung mit dem Internet zu ermöglichen und um Daten in Echtzeit zu sammeln.
Zunehmend werden Objekte des häuslichen und persönlichen Gebrauchs integriert wie z.B. Samsungs revolutionärer Smartfridge, der eine Vielzahl von Daten erfassen kann und dementsprechend Lücken identifiziert, Nachrichten hinterlässt und Käufe online tätigt.
Jedoch gibt es bestimmte rechtliche Aspekte, die Unternehmen und Arbeitgeber berücksichtigen sollten, wie z.B. Datenschutz. Unternehmen tragen eine gewisse rechtliche Verantwortung hinsichtlich der Speicherung und Nutzung von Daten, vor allem weil personenbezogene Informationen die Identität und Intimes einer Person aufdecken können. Daher sollten die verwendeten Verfahren, den in den einzelnen Ländern geltenden Vorschriften entsprechen.
Sicherheitsverletzungen haben rechtliche Folgen für Unternehmen, weshalb die sogenannte Cybersicherheit für die sichere Funktion des Internets der Dinge äußerst wichtig ist. Sicherheitsprotokolle und Datenschutzgesetze müssen stets eingehalten werden.
Zuletzt müssen Unternehmen klar bestimmen, wem die Daten gehören d.h. Eigentumsfragen müssen geklärt werden. Bezüglich des Internets der Dinge bei der Arbeit, um die Effizienz der Mitarbeiter zu messen, sollten Unternehmen berücksichtigen, dass es arbeitsgesetzliche Beschränkungen gibt.
Das Internet der Dinge ist ein technologischer Fortschritt und bietet Unternehmen zahlreiche Chancen. Jedoch entstehen auch Herausforderungen; die Sensibilität für die einschlägigen rechtlichen Vorschriften in anderen Ländern sollte demnach vorhanden sein.

Se refiere a la integración de sensores y dispositivos en objetos de uso cotidiano que permite su conexión a internet con el propósito de recoger datos en tiempo real.
El IoT ofrece soluciones innovadoras y crea excelentes oportunidades para el desarrollo de nuevos productos y campañas de marketing. Por ejemplo, un electrodoméstico multi-tareas que administra la despensa, organiza las tareas del hogar, deja recados y permite compartir y actualizar calendarios. Pero se deben tener en cuenta ciertas consideraciones legales entre las que destacamos la protección de datos.
Las empresas que equipan sus productos con mecanismos capaces de recoger datos se exponen a potenciales responsabilidades legales sobre su almacenamiento y uso. En la actualidad, los datos recogidos a través del IoT se consideran información personal.
Aquellas empresas que trabajan con dispositivos conectados al IoT, deben garantizar la seguridad de los dispositivos y cumplir con la normativa vigente. Se debe determinar claramente quién es el propietario de los datos recogidos por los dispositivos y qué terceras partes tienen acceso a los mismos.
De igual manera, aquellas empresas que incorporen sistemas conectados a internet para medir la eficiencia de sus trabajadores deben recordar que existen limitaciones legales.
El rápido avance tecnológico del Internet de las Cosas presenta numerosas oportunidades para las empresas, así como un gran desafío a la hora de establecer una normativa legal común.
