[value] => Das Verwaltungsgericht Düsseldorf hat mit Urteil vom 15.01.2018 entschieden, dass die der Amazon Fulfillment Germany GmbH von der Bezirksregierung Düsseldorf erteilte Genehmigung, ausnahmsweise an zwei Adventssonntagen Arbeitnehmer im Logistikzentrum in Rheinberg zu beschäftigen, rechtswidrig war. Damit hat das Gericht einer Klage der Vereinten Dienstleistungsgewerkschaft ver.di stattgegeben, die sich in ihrem Grundrecht auf Vereinigungs- und Koalitionsfreiheit verletzt fühlte.
Grundsätzlich dürfen Arbeitnehmer an Sonn- und Feiertagen gemäß § 9 Abs. 1 ArbZG nicht beschäftigt werden. Ausnahmen hiervon sind jedoch zulässig, wenn z.B. besondere Verhältnisse zur Verhütung eines unverhältnismäßigen Schadens gem. § 13 Abs. 3 Nr. 2 b ArbZG die Sonntagsarbeit erfordern. Vorausgesetzt, die Zahl der Sonn- und Feiertage, an denen gearbeitet werden soll, überschreitet nicht die Grenze von fünf Tagen pro Jahr.
Vorliegend war für das VG Düsseldorf nicht erkennbar, dass Amazon ohne Bewilligung der Sonntagsarbeit ein so großer Schaden entstanden wäre, dass dieser das Interesse am Erhalt der Sonntagsruhe hätte überwiegen können. Für das Gericht war bereits zweifelhaft, ob das üblicherweise auftragsstarke Weihnachtsgeschäft eine vom Normalzustand abweichende Sondersituation darstelle – jedenfalls habe Amazon aber nicht zur Überzeugung des Gerichts nachweisen können, dass ihr ohne die Sonntagsarbeit ein unverhältnismäßig hoher Schaden gedroht habe, der mit anderen zumutbaren Mitteln nicht hätte verhindert oder gemildert werden können. Ein bloßes Umsatz- und Erwerbsinteresse genügen nach Auffassung des Gerichts hierfür jedenfalls nicht. Im Übrigen hätte Amazon dem Anstieg des vorweihnachtlichen Bestellvolumens durch eine entsprechende Ausgestaltung des Geschäftsmodells und einer Verteilung auf andere Logistikzentren entgegentreten können.
Damit bestätigte das VG Düsseldorf die Entscheidungen des VG Kassel vom 14.06.2017 und des VG Augsburg vom 15.04.2016, die bereits mit ähnlicher Begründung die Sonntagsbeschäftigung von Amazon für rechtswidrig erklärten.

[value] => El 15 de enero de 2018, el Tribunal Administrativo de Düsseldorf decidió que el permiso otorgado por el gobierno del distrito de Düsseldorf para Amazon Fulfillment Germany GmbH, para que los empleados trabajen durante dos domingos de adviento en el centro logístico de Rheinberg, era ilegal. El Tribunal confirmó una demanda del sindicato ver.di, que se sintió afectado en su derecho fundamental a la libertad de asociación y coalición.
Como regla general no se puede trabajar los domingos y festivos de acuerdo con el § 9 ArbZG. Se permiten excepciones, cuando por condiciones especiales para la prevención de daños desproporcionados según §13 ArbZG se requiere el trabajo dominical, siempre y cuando el número de domingos y festivos trabajados no supere los 5 días por año.
En el presente caso, el Tribunal de Düsseldorf no consideraba que Amazon se pudiera ver perjudicado al no disponer del permiso para trabajar en domingo, por lo que prevalece el interés de mantener el descanso dominical. Para el Tribunal ya era cuestionable si el negocio de Navidad, generalmente de alto volumen, fuera a representar una desviación del estado normal de una situación especial – de todas formas, Amazon no pudo justificar haber sufrido un daño desproporcionado que no se podía haber evitado o mitigado por otros medios razonables.
En todo caso, un mero interés en las ventas y el beneficio no era suficiente, según la opinión del Tribunal. Por otra parte, Amazon podría haber repartido el aumento del volumen de pedidos prenavideños con una reestructuración correspondiente y una distribución y delegación a otros centros logísticos propios.
La sentencia del Tribunal de Düsseldorf confirmó las decisiones del Tribunal de Kassel de 14/06/2017 y del Tribunal de Augsburgo el 04/15/2016, que ya había declarado que el trabajo dominical de Amazon era ilegal, con argumentos parecidos.
