[value] => Das Königliche Gesetzesdekret 15/2018 vom 5. Oktober über Dringlichkeitsmaßnahmen zur Umsetzung der Energiewende und für den Verbraucherschutz schafft neue Verpflichtungen für die Vermarktungsgesellschaften im Energiebereich:
- Finanzhilfen und Unterstützung für die Energieversorgung und Sanktionsordnung
Das Königliche Gesetzesdekret erhöht die jährliche Energiegrenze um 15% mit einem Skontorecht. Dies ermöglicht einen Ausgleich des Preiszuwachses und kommt dem tatsächlichen Verbrauch der bedürftigen Haushalte entgegen. Die Energieversorgung bei Haushalten mit Alleinerziehenden, mit Kindern unter 16 Jahren oder Personen mit einem Behinderungsgrad von mindestens 33% bzw. mit hoher oder sehr hoher Abhängigkeit kann nicht ausgeschlossen werden.
Des Weiteren verlängern sich die Fristen für die Beantragung von Finanzhilfen für die Energieversorgung. Diese direkte finanzielle Unterstützung hilft den betroffenen Haushalten, damit diese die Heiz- und Warmwasserkosten zahlen können und das unabhängig von ihrem Gesamtverbrauch.
Zuletzt wurde die Sanktionsordnung verschärft und somit die Strafe der Vermarktungsgesellschaften ermöglicht, die ihren Verpflichtungen gegenüber den betroffenen Haushalten nicht nachkommen.
- Die Kommunikation und Vertragsbeziehungen zu den Verbrauchern
Das Königliche Gesetzesdekret regelt den Zugang zu den Verbraucherdaten und zur Information bezüglich der maximalen Verbrauchernachfrage. Darüber hinaus wird ein Vertragsabschluss für die Energieversorgung durch ein sogenanntes „Haustürgeschäft“ verboten.
- Missbräuchliche Praktiken der Vermarktungsgesellschaften
Das Königliche Gesetzesdekret sieht im Falle von missbräuchlicher Praktiken der Vermarktungsgesellschaften, unter anderem bei Nichteinhaltung der Abnahmeverpflichtung des Energiekaufs in Tages- oder Interday-Märkten, eine Untauglichkeitserklärung vor.

- La cobertura del bono social, la creación del bono térmico y su régimen sancionador
El RDL incrementa en un 15% los límites de energía anual con derecho a descuento. Así, se compensan los incrementos de precios y se acercan a los consumos reales de los hogares más vulnerables. El suministro a hogares con familias monoparentales, con menores de 16 años, discapacitados de al menos el 33%, o dependientes de grado II o III tendrá carácter esencial y, por tanto, no podrá ser objeto de corte.
Además, se amplían los plazos para la solicitud del bono social eléctrico y sus beneficiarios recibirán a lo largo del invierno el bono social térmico. Este nuevo bono social consiste en una ayuda económica directa para que los hogares vulnerables puedan hacer frente a los gastos de calefacción, agua caliente o cocina, independientemente del combustible que utilicen.
Por último, el Ejecutivo refuerza el régimen sancionador, permitiendo sancionar las conductas de las empresas comercializadoras que incumplan sus obligaciones en relación con la gestión del bono social y los consumidores vulnerables.
- La comunicación y contratación con consumidores
Se regula la posibilidad de que las comercializadoras accedan a información relativa al consumo y a la potencia máxima demandada por los consumidores. Además, se prohíbe para el segmento de consumidores domésticos la contratación del suministro eléctrico en la modalidad “puerta a puerta”.
- Las prácticas fraudulentas de las comercializadoras en el mercado
Se prevé la inhabilitación directa de las comercializadoras que realicen prácticas fraudulentas en el mercado, entre ellas, el incumplimiento de las obligaciones de compra de energía en los mercados diario e intradiarios.
