Oktober veröffentlichte das Europäische Amt für geistiges Eigentum (EUIPO) das Ergebnis einer eigens verfassten Studie, in der es auf einige E-Commerce-Betreiber in der Europäischen Union hinweist, die im Verdacht stehen, Rechte des geistigen Eigentums, insbesondere in Bezug auf Handelsmarken und Domainnamen, zu verletzen.
Der Bericht gibt einen Überblick über die vielen verschiedenen Möglichkeiten, in denen geistiges Eigentum im Geschäftsverkehr verletzt wird. Nach Angaben des EUIPO führen viele der angegebenen Elektronikgeschäfte rechtsverletzende Praktiken mit dem Ziel durch, den Verkehr zu ihren Geschäften im Internet zu erhöhen, indem sie den Namen und die Beliebtheit bekannter Unternehmen und Institutionen nutzen. In diesem Zusammenhang verweist das EUIPO auf den möglichen Ursprung einer kriminellen Organisation, die hinter den meisten der genannten elektronischen Geschäfte stehen könnte. Diese übernehmen umgehend diejenigen Domainnamen, die für eine neue Registrierung frei werden, um Besucher für deren Webseite anzuziehen, in der Produkte verkauft werden, die mutmaßlich Handelsmarken verletzen.
Spanien wurde als eines der Länder genannt, in denen zusammen mit Deutschland, Schweden und dem Vereinigten Königreich die 27.870 Geschäfte, die angeblich gewerbliche Schutzrechte verletzen, lokalisiert werden können. Der geschäftsführende Direktor des EUIPO Antonio Campinos erklärt in diesem Zusammenhang Folgendes: „Dieser neue Bericht liefert weitere Beweise für das Ausmaß des Problems der Verletzung von gewerblichen Schutzrechten im Internet und stärkt die Argumente für eine weitere Zusammenarbeit innerhalb der EU, um die Situation zu kontrollieren”.

El informe ofrece un panorama general de las numerosas y diferentes maneras en que la propiedad intelectual se vulnera en línea desde el punto de vista comercial. Según la EUIPO, muchas de las tiendas electrónicas señaladas están llevando a cabo prácticas infractoras con el objetivo de aumentar el tráfico a sus tiendas en internet, mediante el aprovechamiento del nombre y la popularidad de empresas e instituciones de renombre. En ese sentido, la EUIPO señala al posible origen de organización criminal detrás de la mayoría de las señaladas tiendas electrónicas, que se apropian rápidamente de nombres de dominio cuando éstos quedan libres para un nuevo registro, a efectos de atraer público a sus páginas web y vender productos presuntamente infractores de marcas registradas.
España ha sido citada como uno de los países en los que, junto con Alemania, Suecia y Reino Unido, se pueden localizar las 27.870 tiendas presuntamente infractoras de derechos de propiedad intelectual. El director ejecutivo de la EUIPO, Antonio Campinos, señala al respecto que: “Este nuevo informe aporta más pruebas de la magnitud del problema que representan las infracciones de la propiedad intelectual en línea desde el punto de vista comercial y refuerza los argumentos a favor de la cooperación en el ámbito de la UE para tomar el control de la situación”.
