[value] => Fahnder der Europäischen Kommission sind auf Grund eines Kartellverdachts bei verschiedenen deutschen Automobilherstellern, darunter Daimler, BMW und VW samt Töchtern, vorstellig geworden. Derzeit finden Vorprüfungen statt, ein offizielles Verfahren ist bislang nicht eingeleitet worden. So sollen die drei Konzerne im Verdacht stehen, sich jahrelang abgesprochen zu haben bezüglich ihrer Autos, Kosten und Zulieferer. Derartige Abreden im Automobilbereich sind durchaus gängig, so beispielsweise, um Standards für die Ladung von Elektroautos abzusprechen. Bedingung ist dabei allerdings immer, dass die Zusammenarbeit den Verbrauchern Vorteile bringt, die sonst nicht möglich wären. Vorliegend ist aber fraglich, inwieweit die zulässige Grenze einer Zusammenarbeit überschritten worden sein konnte. Daimler und VW sollen einen Antrag auf die Anwendung der Kronzeugenregelung gestellt haben, wobei Daimler VW zeitlich zuvorgekommen sein soll, und damit von der Kronzeugenregelung profitieren würde. Unternehmen, die ein Kartell, an dem sie beteiligt sind, anzeigen, können den vollständigen Erlass der Geldbuße beantragen, wenn es als erstes Unternehmen Beweise für ein der Europäischen Kommission bis dahin unbekanntes Kartell vorlegt oder auch - falls die Kommission bereits von dem Kartell wusste - ihr als erstes Unternehmen entscheidende Beweise vorlegt, die die Feststellung des Kartells ermöglichen.
BMW ist „irritiert“ bezüglich der Anträge von Daimler und Volkswagen, und führt aus: „Im Rückblick ist es ein komisches Gefühl, dass wir mit den Wettbewerbern über Zusammenarbeit redeten, während deren Juristen die Zusammenkünfte schon angezeigt hatten bei den Wettbewerbsbehörden.“
Nun bleibt abzuwarten, ob ein offizielles Verfahren eingeleitet wird, und was dessen Ergebnis sein könnte.

Se sospecha que hayan pactado elementos clave de la planificación de su estrategia empresarial, su estructura de costes, el uso de determinadas tecnologías y sus proveedores, lo que podría significar una práctica anticompetitiva. No obstante, estos acuerdos pueden ser conformes a la ley como lo son, por ejemplo, los realizados para acordar normas estándar para coches eléctricos. El requisito para considerar estos acuerdos como legales es que supongan una ventaja para el consumidor que de otra manera, no se podría conseguir. No obstante, en este caso no está claro si los acuerdos se mantuvieron dentro de este marco legal o si habrían superado el límite. Daimler y VW han solicitado clemencia. Daimler, al haberla solicitado primero, podría probablemente beneficiarse de las regulaciones para los solicitantes de clemencia, minorándose o condonándose totalmente la posible multa. Las empresas que denuncien un posible cártel en el que participan, no solo pueden beneficiarse de la normativa para los solicitantes de clemencia antes de que la Comisión Europea tenga conocimiento de ello, sino que podrían beneficiarse también después de que la Comisión sospeche un cártel si la empresa solicitante aporta pruebas significativas en el proceso para demostrar la existencia de este cártel.
BMW se muestra “extrañado” por las solicitudes de Daimler y Volkswagen y expone que analizándolo con perspectiva, es extraño haber negociado con los competidores una posible cooperación mientras que sus abogados ya estaban denunciando los encuentros a las autoridades de competencia.
Habrá que esperar a que se abra, si se abre, una investigación formal y sus posibles consecuencias.
