Ebenso ist bekannt, dass diese Ausnahmebestimmung sich in einer Demokratie auf einige wenige privatrechtliche Vertragsverhältnisse beschränkt. Nun hat das spanische Parlament fast unbemerkt, während Spanien im Katalonienfieber steckte, im September einen Gesetzesvorschlag zur parlamentarischen Debatte zugelassen, der die Beweislastumkehr im Anwendungsbereich des vorgeschlagenen Gesetzes zur Regel macht. Wer beschuldigt wird, der muss sich exkulpieren, so bestimmt es Art. 73 des Entwurfes für ein Gesetz, (Proposición de Ley 122/000097). Ich hatte wenn schon keinen Sturm der Entrüstung doch wenigstens ein juristisches Stirnrunzeln erwartet, ob diese Regelung, die etwas an Torquemada erinnert und besser zu einer Diktatur passt als zu einem EU-Mitgliedstaat.

[value] => La carga de la prueba puede definirse como un principio de derecho: el demandante es obligado a probar los hechos controvertidos, la falta de acreditación lleva a la desestimación de su pretensión. Este principio rige nuestro ordenamiento jurídico. Sin embargo, el legislador ha creado una cantidad de excepciones, y parece que una nueva está llegando a través de la Proposición de Ley 122/000097, admitida a trámite por el congreso en septiembre. Esta propuesta introduce en su Art. 73 la inversión de la carga de la prueba del denunciante al denunciado, que tienen que demostrar su inocencia. Su regulación hará difícil para los últimos exculparse. Llama sobremanera la atención – y nos debería preocupar – que en esta proposición se usa la inversión de la carga también para un control de conducta, impuesta por el estado, de personas e instituciones privadas. Un sistema probatorio que nos recuerda a tiempos pasados, más apropiado en nuestros tiempos para dictaduras que Estados Miembros de la UE.
