[value] => Wieder hat die Wahl der Mitglieder und des Präsidenten des Consejo General del Poder Judicial (CGPJ) für Polemik gesorgt. Der CGPJ ist das Regierungsorgan der spanischen Richter. Es handelt sich nicht um ein Organ mit Gerichtscharakter, aber es ist u.a. für die Auswahl der Richter an den verschiedenen Gerichten zuständig.
Das Problem existiert schon seit Jahren. Die spanische Verfassung sieht vor, dass der CGPJ sich aus 20 Mitgliedern und einem Präsidenten zusammensetzt. Der Präsident ist gleichzeitig auch der Präsident des spanischen Obersten Gerichtshofs. In Par. 122 der Verfassung ist geregelt, dass von den 20 Mitgliedern 12 Berufsrichter zu sein haben und die restlichen 8 Anwälte oder Juristen von anerkannter Befähigung und mehr als 15-jähriger Erfahrung. Hinsichtlich dieser 8 Mitglieder schreibt die Verfassung vor, dass sie „auf Vorschlag“ des Parlaments gewählt werden. Bezüglich der Wahl der 12 Berufsrichter enthält die Verfassung keine Vorschrift.
Bis zum Inkrafttreten des Justizorgangesetzes in 1985 wurden diese 12 Mitglieder aus den Reihen der Berufsrichter von den Richtern selbst gewählt, ohne Intervention des Parlaments. Seit Inkrafttreten werden alle 20 Mitglieder „auf Vorschlag“ des Parlaments gewählt. In der Praxis hat dies zur Folge, dass die politischen Parteien im Voraus untereinander vereinbaren, wer Mitglied des CGPJ wird.
Beim letzten Mal ist nicht nur die Zusammensetzung des Organs im Voraus vereinbart worden, sondern auch, wer den Vorsitz führen soll, obwohl das Justizorgangesetz vorschreibt, dass der Präsident in der ersten Sitzung von den Mitgliedern zu wählen ist. Das heißt, man wusste, wer Präsident des Organs sein würde, bevor überhaupt die Mitglieder des Organs bekannt waren. All dies, zusammen mit einem sehr unglücklichen Whatsapp hat dazu geführt, dass der Kandidat -im Voraus- auf seine Ernennung verzichtet hat. Wie diese Affäre enden wird, ist noch ungewiss, aber die nachgewiesene Absicht der politischen Parteien das Regierungsorgan der Justiz zu kontrollieren, lässt nichts Gutes ahnen.

[value] => Una vez más se ha generado una importante polémica a la hora de elegir a los miembros del CGPJ, así como a su Presidente. El CGPJ es el órgano de gobierno de los jueces. No es un órgano judicial, es decir no dicta sentencias, pero es el responsable, entre otras cosas, de los nombramientos de los jueces y magistrados en los diferentes juzgados y tribunales.
El problema se lleva arrastrando desde hace años. La Constitución Española (CE) prevé que el CGPJ esté compuesto por 20 vocales más un Presidente, que lo será también del Tribunal Supremo (TS). En su art. 122, la CE prevé que, de los 20 miembros, 12 pertenecerán a la carrera judicial y otros 8 serán abogados o juristas de reconocida competencia y con más de 15 años de experiencia. Respecto de estos 8 miembros, la Constitución dice que serán elegidos “a propuesta” de las Cortes, pero no dice nada respecto de la elección de los otros 12 miembros (los que pertenecen a la carrera judicial).
Hasta la aprobación de la Ley Orgánica del Poder Judicial (LOPJ) en 1985, esos 12 miembros provenientes de la carrera judicial eran elegidos por los propios Jueces y Magistrados, sin intervención de las Cortes. Tras la LOPJ, sin embargo, los 20 vocales pasan a ser elegidos “a propuesta de” las Cortes, lo que en la práctica supone que los principales grupos parlamentarios (partidos políticos) pactan de antemano los nombres de los que serán vocales del CGPJ.
En esta última ocasión, además, no sólo se ha pactado la composición del CGPJ, sino además quién iba a presidirlo, cuando la LOPJ establece que son los vocales, en la primera sesión, los que elegirán a su Presidente. Es decir, antes de conocer siquiera los nombres de los vocales “propuestos” por las Cortes, ya se sabía quién iba a presidir el GCPJ (y con ello el Tribunal Supremo). Ello, unido a algún “whatsapp” muy desafortunado, ha llevado al candidato a renunciar –de antemano- a la Presidencia que ya había sido pactada. Veremos cómo acaba, pero lo cierto es que la acreditada voluntad de los grupos políticos de controlar el CGPJ no augura nada bueno.
