[value] => Wie bekannt ist, sind die Steuerschuldner der spanischen Körperschaftsteuer allgemein dazu verpflichtet diese Geschäfte zu dokumentieren, wenn diese je verbundener Partei 250.000 € oder in besonderen Fällen 100.000 € pro Jahr übersteigen. Es gibt jedoch Fälle, in denen u.a. der Geschäftsumsatz der Gesellschaft oder des Konzerns Beachtung fand und dadurch die Dokumentation vereinfacht oder die Gesellschaft von dieser Pflicht befreit wurde.
Der spanische oberste Gerichtshof (Tribunal Supremo, TS) hat am 15. Oktober 2018 mit seinem Urteil die Zweifel ausgeräumt, die bezüglich der Anwendung der Sanktionen bei der Dokumentation von Verrechnungspreisen bei befreiten Unternehmen bestanden. Die Beschwerde führende Gesellschaft hatte vor dem TS argumentiert, dass aufgrund der besonderen Sanktionen bei Ausnahme des Unternehmens von der Verpflichtung zur Dokumentation der Verrechnungspreise keine Sanktion Anwendung finden kann, auch keine allgemein geltende Sanktion. Dies gelte auch, wenn die Steuerbehörde im Rahmen einer Steuerprüfung eine Wertkorrektur durchgeführt hat.
Der TS hat die durch den Beschwerdeführer vorgebrachte Möglichkeit abgewiesen und daher festgestellt, dass die Gesellschaft, auch wenn Sie von der Dokumentationsverpflichtung befreit ist, dennoch den allgemeinen Sanktionsregeln unterfallen kann. Das bedeutet in der Praxis, dass die Steuerbehörde im Rahmen einer Prüfung die Bewertung der Verrechnungspreise anpassen, die noch nicht eingezogenen Steuern einfordern und die entsprechende Sanktion verhängen kann.
An dieser Stelle darf nicht außer Acht gelassen werden, dass die Unternehmen ihre Geschäfte immer zum Marktpreis bewerten müssen. Daher ist es in einigen Fällen empfehlenswert, die Dokumentationsverpflichtung zu erfüllen, auch wenn die Gesellschaft von dieser Verpflichtung ausgenommen ist. So hat die Gesellschaft einen handfesten Beweis gegen die Einnahmengier der Steuerbehörde, vor allen Dingen, wenn innerhalb eines Konzerns Geschäfte getätigt werden.

[value] => Como es conocido, los contribuyentes del IS tienen con carácter general la obligación de documentar estas operaciones, cuando superen los 250.000 euros anuales por entidad vinculada o 100.000 euros en ciertos casos específicos. Sin embargo, existen supuestos de exoneración o simplificación en la documentación tomando en cuenta el volumen de negocios de la sociedad o del grupo al que ésta pertenece, entre otros factores.
La reciente sentencia del Tribunal Supremo (TS) de 15 de octubre de 2018, ha venido a despejar las dudas que existían en relación a la aplicación del régimen sancionador de operaciones vinculadas, precisamente cuando las compañías están exentas de esta obligación. Según la entidad recurrente del mencionado recurso ante el TS, por tener el régimen sancionador carácter especial, cuando entra en juego la exención de confeccionar la documentación de operaciones vinculadas no podría existir sanción alguna – tampoco por el régimen general -, y ello, aunque la administración tributaria en el seno de un procedimiento inspector hubiera llevado a cabo una corrección valorativa.
Pues bien, el TS ha negado dicha posibilidad defendida por el recurrente y, por lo tanto, aunque la entidad esté exonerada de cumplir las obligaciones de documentación, se podría aplicar el régimen general sancionador. Y esto en la práctica significa que la Administración puede en el seno de una comprobación, modificar la valoración que se han dado a operaciones vinculadas, exigir los impuestos que hayan dejado de ingresar y, además, interponer la correspondiente sanción.
No podemos olvidar que las entidades deben valorar siempre sus operaciones a valor de mercado. Es por ello que resulta recomendable en ciertos supuestos cumplir con las obligaciones de documentación, y ello a pesar de que la entidad esté exenta de esta obligación. Así, se tendría una prueba sólida contra la voracidad recaudatoria de la Administración, sobre todo cuando existan operaciones intragrupo.
