[value] => Die Kommunikation unter Nutzung der neuen Technologien, wie WhatsApp, kann zu Problemen führen, da diese nicht in der geltenden Arbeitsgesetzgebung geregelt ist. Wovon hängt es ab, ob die Arbeitsgerichte eine Mitteilung mittels WhatsApp als beweiskräftig anerkennen? Im Fall der Kündigung verlangt das Arbeitnehmerstatut, dass diese dem Arbeitnehmer schriftlich zugestellt wird und in ihr der die Beendigung des Arbeitsverhältnisses rechtfertigende Sachverhalt dargestellt wird.
Diese klare und präzise Angabe der Kündigungsgründe dient als Garantie dafür, dass dem Arbeitnehmer der ihm vorgeworfene Sachverhalt bekannt wird. Dementsprechend hat der Oberste Gerichtshof in seinem Urteil vom 19. Mai 2015 festgestellt, dass “der Beweis einer bidirektionalen Kommunikation mittels irgendeines der vielfältigen Instant Messaging-Systeme mit grosser Vorsicht zu behandeln ist. Die Möglichkeit einer Manipulation der digitalen Archive, mittels derer der Kommunikationsaustausch erfolgt, ist eine Realität. Die Anonimität, die von diesen Systemen zugelassen wird, sowie die Kontoerstellung unter einer vorgetäuschten Identität, machen es möglich, eine Kommunikation vorzutäuschen, bei der ein einziger Nutzer mit sich selbst kommuniziert”. Dies hat zur Folge, dass eine mittels WhatsApp vorgenommene Kündigungsmitteilung nicht den gesetzlichen Anforderungen entspricht und daher die Arbeitsgerichte diese Kündigungen für unzulässig ansehen.
Im Gegensatz hierzu wurde in verschiedenen Urteilen die Mitteilung der Eigenkündigung des Arbeitnehmers mittels WhatsApp als eine eindeutige Erklärung seiner Kündigungsabsicht angesehen. Der Unterschied beruht darauf, dass das Arbeitnehmerstatut im Fall der Eigenkündigung keine formale Erklärung verlangt, sondern nur eine Handlung des Arbeitnehmers, die ausdrücklich oder stillschweigend seinen Willen zum Ausdruck bringt, seine Arbeitstätigkeit nicht fortsetzen zu wollen. Die Wirksamkeit von Erklärungen mittels WhatsApp hängt daher von der Art der Mitteilung und der Situation des Arbeitnehmers ab.

[value] => La comunicación a través de las nuevas tecnologías, como el WhatsApp, trae consigo una problemática en el momento en que no esté regulado en la normativa laboral vigente. Por tanto, ¿de qué depende que el juzgador valore como medio de prueba una comunicación a través de WhatsApp? En lo que respecta al despido, el Estatuto de los Trabajadores exige que el mismo se notifique por escrito y expresando los hechos que motivan la decisión extintiva.
Dicha indicación clara y precisa de las causas sirve de garantía para que el trabajador conozca los hechos que se le imputan. Teniendo en cuenta lo anterior, la sentencia del Tribunal Supremo de 19 de mayo de 2015 dispone que “la prueba de una comunicación bidireccional mediante cualquiera de los múltiples sistemas de mensajería instantánea debe ser abordada con todas las cautelas. La posibilidad de una manipulación de los archivos digitales mediante los que se materializa el intercambio de ideas, forma parte de la realidad de las cosas. El anonimato que autorizan tales sistemas y la libre creación de cuentas con una identidad fingida, hacen perfectamente posible aparentar una comunicación en la que un único usuario se relaciona consigo mismo”. Lo que implica que una comunicación de despido realizada vía WhatsApp no cumple con los requisitos legales y por consiguiente, el juzgador declara tales despidos como improcedentes.
Al contrario, en diferentes sentencias se ha aceptado la comunicación de la baja voluntaria del trabajador mediante WhatsApp como una manifestación inequívoca de su voluntad de dimitir. La diferencia radica en que el Estatuto de los Trabajadores en relación con la baja voluntaria no exige una declaración formal, sino únicamente una actuación del trabajador mediante la que demuestra de manera expresa o tácita su voluntad de no reincorporase al trabajo. Por lo que la validez de las manifestaciones realizadas vía WhatsApp dependerá del tipo de comunicación y situación del trabajador.
