[value] => In einem jüngst veröffentlichten Beschluss vom 23.7.2019 (BFH XI B 29/19) hat der Bundesfinanzhof seine Rechtsprechung bestätigt, wonach im deutschen Umsatzsteuerrecht die Angemessenheit des Entgelts im Hinblick auf den objektiven Wert von Leistung und Gegenleistung ohne Belang ist, solange feststeht, dass Leistung und Gegenleistung miteinander innerlich verbunden sind. Auf eine mögliche ertragssteuerrechtliche Einstufung als verdeckte Gewinnausschüttung (vgl. hierzu BFH vom 25.11.1987 - X R 12/81) oder Art und Umfang anderer ertragssteuerlicher Korrekturen, wie z.B. die nicht fremdüblicher Verrechnungspreise nach den Vorschriften des deutschen Außensteuergesetzes (AStG) im Rahmen von Art. 9 DBA, komme es umsatzsteuerlich nicht an.
Deutschland habe von der Option des Art. 80 Abs. 1 Satz 1 Buchst. c MwStSystRL keinen Gebrauch gemacht, der die Mitgliedstaaten berechtigt, unter bestimmten Voraussetzungen einen Missbrauch anzunehmen und den Vorsteuerabzug zu versagen. Der deutsche Gesetzgeber habe bei Einführung von § 10 Abs. 5 Satz 2 UStG zum Ausdruck gebracht, dass nur im Sonderfall der verbilligten Leistungen an den in § 10 Abs. 5 UStG benannten Personenkreis die sog. Mindestbemessungsgrundlage zu prüfen und eine Begrenzung auf das marktübliche Entgelt vorzunehmen sei. Eine analoge Anwendung dieser Regelungen käme nicht in Betracht, da die Regelung als nationale Sondermaßnahme eng auszulegen sei (vgl. BFH-Urteil vom 28.06.2017 - XI R 12/15), auch die allgemeine Missbrauchsregelung von § 42 AO käme in Fällen des überhöhten Entgelts nicht zur Anwendung (BFH vom 03.03.1988 - V R 183/83). Ähnliche Erwägungen hatte in zollrechtlicher Hinsicht bereits der Europäische Gerichtshof im Rahmen eines Vorabentscheidungsersuchens des Finanzgerichts München nach Art. 267 AEUV (Beschluss vom 15.09.2016 – 14 K 1974/15) angestellt (Urteil vom 20.12.2017 - C-529/16 – Rechtssache Hamamatsu Photonics Deutschland GmbH), wonach auch der Zollwert in erster Linie auf der Grundlage des vereinbarten Transaktionswerts zu bestimmen sei.

[value] => El Tribunal Federal Supremo de lo Fiscal ha reconfirmado su jurisprudencia con una resolución del 23/07/2019 (BFH XI B 29/19), recién publicada, según la cual el concepto de importe total de la contraprestación en el IVA no requiere de la existencia de una relación donde se adecúe el valor de una operación y la contraprestación pero sí debe existir un nexo entre ambas. La clasificación de una contraprestación a efectos de los impuestos sobre la renta como dividendo encubierto (BFH X R 12/81) o bien por el tipo o el volumen de las correcciones, como por ej. de los precios de transferencia según la Ley Alemana de Fiscalidad Exterior conforme con el art. 9 CDI, no tiene ninguna relevancia a los efectos de IVA.
Alemania no recurrió a la opción ofrecida por el art. 80 (1) fr. 1 letra c de la Directiva de la UE del IVA que da derecho a cada país de introducir un concepto de abuso según determinadas condiciones y por ello denegar la deducción del IVA soportado. Más bien, la legislación alemana indicó, al incorporar el § 10 (5) fr. 2 de la LIVA alemana (UStG), que se debe comprobar solamente en situaciones especiales de operaciones muy abaratadas con las personas mencionadas en el § 10 (5) UStG y en su caso, aplicarse el concepto de la base imponible mínima, y al confirmarse, establecer un ajuste a las condiciones del mercado. Una aplicación mutatis mutandi de esta regularización no sería posible debido a que habría que interpretar esta regla nacional especial de manera restringida (BFH XI R 12/15), asimismo la reglamentación general del concepto de abuso según art. (§) 42 LGT alemana no se aplicaría en caso de una contraprestación excesiva (BFH V R 183/83). Consideraciones semejantes en cuanto a disposiciones aduaneras fueron aplicadas por el Tribunal de Justicia de las UE en el marco de un procedimiento de decisión prejudicial (sentencia del 20/12/2017 - C-529/16) planteado por el Tribunal de lo Fiscal de Múnich según el art. 267 TFUE (14 K 1974/15), por el cual el valor aduanero sería determinado por el valor acordado entre las partes que efectúan la transacción.
