[value] => Am 01. November trat das Gesetz zur Einführung einer zivilprozessualen Musterfeststellungsklage in Kraft. Noch am selben Tag reichten der Bundesverband der Verbraucherzentralen und der ADAC gemeinsam eine Musterfeststellungsklage gegen die Volkswagen AG ein.
Anlass für die Einführung der Musterklage ist die Vielzahl gleichartig geschädigter Verbraucher durch den Dieselskandal. Das neue Gesetz soll die Möglichkeit bieten, ohne großen (finanziellen) Aufwand Ansprüche gegen große Konzerne, in dem Fall gegen die Volkswagen AG, durchzusetzen. Da die Ansprüche der durch den Dieselskandal geschädigten Verbraucher gemäß der 3-jährigen Regelverjährung zum 1. Januar 2019 verjähren würden, ist der Zeitpunkt für die Einführung des Gesetzes bewusst gewählt.
Der Sinn und Zweck dieser zivilrechtlichen Verbandsklage besteht darin, dass es statt vieler Einzelklagen, eine Musterklage gibt, der sich jeder Betroffene bis zu einem bestimmten Zeitpunkt anschließen kann und so die Rechte einzelner Verbraucher gegenüber großen Konzernen zu stärken. Die Klage ist zulässig, wenn sich zu einem Stichtag mind. 50 betroffene Verbraucher wirksam eingetragen haben – bis dato wurden Klagen nur bei Verletzungen subjektiver Rechte zugelassen.
Sollte das Gericht zugunsten der klageführenden Verbände entscheiden, muss allerdings jeder im Klageregister eingetragene Verbraucher daraufhin seine Schadenersatzansprüche individuell gerichtlich durchsetzen. Das heißt, trotz eines positiven Feststellungsurteils einer Musterklage, kann der Betroffene theoretisch ein negatives Urteil erhalten.
Kritisch wird gesehen, dass Verbraucher sich nur über ausgewählte Verbände zusammenschließen können, welche die Klage dann einreichen, sowie eine eventuelle Überlastung der Gerichte durch Einzelklagen.
Zusammenfassend lässt sich also sagen, das Gericht entscheidet mit einem Urteil bei einer Musterfeststellungsklage also lediglich, ob ein Sachverhalt vorliegt, der den Verbraucher zur Zahlung von Schadensersatz durch den Beklagten berechtigt, ohne dass dieser dabei ein finanzielles Risiko trägt.

[value] => El 1 de noviembre entró en vigor la ley sobre la introducción de una acción declarativa modelo de procedimiento civil. El mismo día, el Bundesverband der Verbraucherzentralen y el ADAC presentaron conjuntamente una demanda tipo de sentencia declarativa contra Volkswagen AG.
La introducción de la demanda modelo fue motivada por el gran número de consumidores que sufrieron daños similares a consecuencia del escándalo del gasóleo. La nueva ley ofrece la posibilidad de presentar reclamaciones contra grandes empresas, en este caso contra Volkswagen AG, sin riesgos (económicos). Dado que las reclamaciones de los consumidores afectados expirarían el 1 de enero de 2019, según el plazo de prescripción estándar de 3 años, se ha elegido a conciencia la fecha para la implantación de la ley.
El propósito de esta demanda civil colectiva es reemplazar muchas demandas individuales por una demanda modelo a la que pueda unirse cualquier parte interesada hasta una fecha límite, fortaleciendo así los derechos de los consumidores individuales frente a las grandes corporaciones. El recurso será admitido si al menos 50 consumidores afectados se han registrado hasta una fecha de fijada.
Sin embargo, si el tribunal decide a favor de las asociaciones de demandantes, cada consumidor inscrito en el registro judicial deberá hacer valer individualmente sus reclamaciones de indemnización por daños y perjuicios ante los tribunales. Esto significa que, a pesar de un juicio declarativo positivo de una acción modelo, para la persona afectada, teóricamente, el fallo puede resultar negativo.
Se ve con ojos críticos que los consumidores sólo puedan unirse por medio de algunas asociaciones elegidas, que serían quienes presenten la denuncia, así como una posible sobrecarga de los tribunales por las denuncias individuales.
En resumen, puede decirse que el tribunal con la sentencia sólo decide si existen hechos que den derecho al consumidor al pago de daños y perjuicios por parte del demandado. El consumidor no asume ningún riesgo económico hasta que se haya dictado la sentencia declaratoria.
