[value] => Diesen Monat hat der Allgemeine Rat der spanischen Rechtsanwaltschaft (Consejo General de la Abogacía Española) das sogenannte Registro de Impagados Judiciales, ein Register für gerichtlich anerkannte Schulden, vorgestellt. Das Register ist eine wegweisende Entwicklung in unserem Land, ein Säumnisverzeichnis, in die Anwälte nach vorheriger Zustimmung des forderungsberechtigten Mandanten die „feststehenden, fälligen, einforderbaren und mittels endgültiger Gerichtsentscheidung anerkannten Schulden“, die über einen Betrag von 50,00 € hinausgehen, für maximal fünf Jahre aufnehmen können.
Obgleich die großen Finanzinstitute bereits über Verzeichnisse dieser Art verfügen, wird geschätzt, dass 80 % der geschäftlichen Verbindlichkeiten in kein Verzeichnis aufgenommen wird. Das neue Register erlaubt es den Rechtsanwälten einen höheren Druck auf die Schuldner auszuüben. Es bietet Rechtsanwälten ferner die Möglichkeit Informationen zur Nichtzahlung von Anwaltshonoraren zu einzusehen.
Letztendlich sollen in dieses in ganz Spanien gültige Verzeichnis Gerichtsentscheidungen, wie zur Nichtzahlung von Unterhalt, Schulden zwischen Privatpersonen, Nichterfüllungen von Miet- oder Warenkaufverträgen, aufgenommen werden. Auch Säumnisse durch endgültige Urteile zur Zahlung verurteilter Institutionen werden eingeschlossen sein.
Das Register ist also eine bahnbrechende Innovation in Spanien, mit der das Recht auf effektiven Rechtsschutz garantiert wird und die dazu dienen soll, dass endgültige Urteile erfüllt werden. Dadurch ermöglicht sie eine höhere Transparenz des spanischen Rechts- und Finanzsystems.

Se trata de un fichero de morosidad pionero en nuestro país por el cual, previa autorización del cliente acreedor, los abogados podrán incorporar en el fichero las “deudas líquidas, vencidas, exigibles y reconocidas mediante resolución judicial firme” que sobrepasen los 50 euros y por un tiempo máximo de cinco años.
Aunque las grandes entidades financieras ya cuentan con ficheros de este tipo, sin embargo se estima que el 80% de la deuda comercial no queda registrada en ningún listado, por lo que este nuevo registro permitirá a los abogados ejercer mayor presión sobre los deudores. Además, permitirá a los abogados contar con un registro para consultar datos sobre el impago de honorarios de letrados.
En definitiva, este fichero - que tendrá validez en toda España - está previsto que contenga resoluciones judiciales, tales como los impagos de las pensiones de alimentos, las deudas entre particulares, incumplimientos en contratos de alquiler o contratos de compraventa de mercancías. Incluirá también la morosidad de instituciones condenadas a pagar por sentencia firme.
Estamos pues ante una innovación revolucionaria en España que, asegurando el derecho a la tutela judicial efectiva, se pretende sirva para garantizar que se cumplan las sentencias firmes y para dotar de mayor transparencia al sistema judicial y financiero español.
