[value] => Das war ein langer und qualvoller Weg, aber sein Ende ist in Sicht und anscheinend mit schlechten Nachrichten für die spanische Steuerbehörde. Wie weithin bekannt ist, waren die bösen Folgen einer nicht fristgemäßen Erklärung der im Ausland belegenen Güter eine Pflicht zur Zahlung von 50 % des – fiktiven – Gewinns im Rahmen der Einkommensteuer und einer Sanktion i. H. v. 150 %.
Die EU-Kommission hat schließlich beschlossen, Spanien angesichts seines Widerstands zur Anpassung des Formulars 720 vor den Europäischen Gerichtshof zu bringen. Wir begrüßen diese Entscheidung.
Ein weiterer Grund veranlasst uns dazu, das baldige Ableben dieser drakonischen Vorschrift vorherzusehen. Die spanischen Gerichte geben in ihren Urteilen denjenigen mutigen Bürgern immer öfter Recht, die entschiedenen haben, gegen Goliath anzutreten. Der oberste Gerichtshof von Madrid hat in seinem im Januar 2019 gefällten Urteil die Steuerbehörde zurechtgewiesen und sie dazu verpflichtet, die Prozesskosten für die Sanktionierung eines Steuerzahlers zu zahlen, welcher freiwillig – jedoch nicht fristgemäß – die Verpflichtungen des Formulars 720 erfüllt hat, als bereits eine begründete Stellungnahme der EU-Kommission, in der die rechtlichen Zweifel an der Angemessenheit dieser Sanktionen bereits erläutert wurden, vorlag. Eine weitere Entscheidung des zentralen Finanzgerichts (Tribunal Económico-Administrativo Central, TEAC) geht in die gleiche Richtung.
Wir haben daher Hoffnung für die nächste Anpassung dieses aberwitzigen Gesetzes. In jedem Fall möchten wir aber unterstreichen, dass die Gerichte die „freiwillige“ Erklärung der Steuerpflichtigen ihrer im Ausland belegenen Vermögenswerte positiv bewerten, auch wenn diese nicht fristgemäß erfolgt. Wie wir es seit 2013 tun, empfehlen wir den Steuerpflichtigen, genauso vorzugehen, da unsere Erfahrung bis heute damit stets positiv war.

[value] => Ha sido éste un largo y tortuoso viaje, pero se vislumbra ya su final, y parece ser que con malas noticias para la Administración. Como es de sobra conocido y es su efecto más perverso - la declaración fuera de plazo de bienes en el extranjero suponía tener que pagar en el IRPF alrededor del 50% de su valor como ganancia – ficticia - y una sanción del 150%. Es decir, la pérdida del patrimonio situado en el extranjero.
Pues bien, finalmente la Comisión Europea ha decidido llevar a España ante el Tribunal de Justicia de la Unión Europea ante su resistencia a modificar el modelo 720. Decisión que aplaudimos.
Y existe otro hecho además que nos lleva a considerar en la pronta defunción de esta norma draconiana. Las resoluciones de los tribunales españoles comienzan a dar la razón a aquellos valientes ciudadanos que han decidido plantarle cara a Goliat. Así, el TSJ de Madrid da un tirón de orejas a la Administración en una sentencia de enero de 2019, y le obliga a pagar las costas del procedimiento por sancionar a un contribuyente que había cumplido voluntariamente – pero fuera de plazo – las obligaciones del modelo 720, cuando ya existía un dictamen de la Comisión Europea que exponía las dudas jurídicas sobre la proporcionalidad de las sanciones. Otra resolución reciente del TEAC va en el mismo sentido.
Tenemos pues esperanza en la próxima modificación de esta disparatada ley; pero, en cualquier caso, queremos subrayar que los tribunales valoran muy positivamente que los contribuyentes declaren de forma “voluntaria”, aunque sea extemporáneamente, sus bienes en el extranjero y, como llevamos haciendo desde 2013, recomendamos los contribuyentes procedan de esta manera, pues hasta la fecha la experiencia ha sido siempre positiva.
