[value] => Das Königliche Gesetzesdekret 6/2019 über „Dringende Maßnahmen zur Gewährleistung der Gleichbehandlung und Chancengleichheit von Frauen und Männern in Beschäftigung und Beruf“ hat das Recht eines jeden Arbeitnehmers auf Anpassung seines Arbeitstages eingeführt, um Familien- und Berufsleben vereinbaren zu können. Bisher verlangte Artikel 34.8 des Arbeiterstatuts, dass die Anpassung der Arbeitszeit im Tarifvertrag vorgesehen oder von den Parteien vereinbart werden musste. Nunmehr hat jeder Arbeitnehmer das Recht, Dauer und Verteilung der Arbeitszeit in der Gestaltung der Arbeitszeit und der Form ihrer Leistung anzupassen, einschließlich der Telearbeit.
Arbeitnehmer können somit ihre Arbeitszeit „auswählen“, vorausgesetzt, die Anpassungen sind angemessen und verhältnismäßig im Hinblick auf die Bedürfnisse des Arbeitnehmers und die organisatorischen oder produktiven Bedürfnisse des Unternehmens. Beantragt ein Arbeitnehmer eine solche Anpassung, wird während maximal 30 Tagen ein Verhandlungsprozess eröffnet, der mit der Entscheidung des Unternehmens endet, den Antrag anzunehmen, Alternativen anzubieten oder den Antrag abzulehnen, wobei im letzteren Fall die objektiven Gründe zur Rechtfertigung der Entscheidung darzulegen sind. Im Falle von Diskrepanzen kann sich der Arbeitnehmer ohne vorherige Schlichtung an die Arbeitsgerichte wenden, wobei gegen das Urteil derselben kein Rechtsmittel eingelegt werden kann. Ebenso kann der Arbeitnehmer die Rückkehr zu seiner vorherigen Arbeitszeit oder Vertragsmodalität verlangen, auch wenn der vereinbarte Anpassungszeitraum noch nicht abgelaufen ist, soweit er eine Änderung seiner Umstände rechtfertigen kann. Es bleiben die Auswirkungen auf die Organisation der Unternehmen abzuwarten sowie die ersten Urteile, um die Kriterien zu kennen, die von den Richtern zur Entscheidung angewandt werden, ob die Bedürfnisse des Arbeitnehmers oder die organisatorischen oder produktiven Bedürfnisse des Unternehmens vorherrschen.

[value] => El Real Decreto-ley 6/2019, de 1 de marzo, de medidas urgentes para garantía de la igualdad de trato y de oportunidades entre mujeres y hombres en el empleo y la ocupación, ha introducido el derecho de cualquier empleado a adaptar su jornada de trabajo para conciliar su vida familiar y laboral. Antes de su modificación, el artículo 34.8 del Estatuto de los Trabajadores disponía que el derecho a la adaptación de la jornada debía estar recogido en el Convenio Colectivo o acordado por las partes. En la actualidad, este artículo establece que cualquier empleado tendrá derecho a adaptar la duración y distribución de la jornada, en la ordenación del tiempo de trabajo y forma de prestación, incluido el teletrabajo. Como consecuencia, se permite que un trabajador “elija” su jornada, siempre que las adaptaciones sean razonables y proporcionadas en relación con las necesidades del trabajador y con las necesidades organizativas o productivas de la empresa.
En caso de que un trabajador solicite la adaptación de su jornada, se abrirá un proceso de negociación durante un periodo máximo de 30 días, finalizando con una decisión empresarial que acepte la solicitud, plantee alternativas a la solicitud inicial o deniegue la misma, debiendo justificar en este último caso las razones objetivas que respaldan la decisión. En caso de disconformidad, el trabajador podrá recurrir ante la jurisdicción social sin necesidad de conciliación previa. Cabe señalar que contra la sentencia no cabrá recurso alguno. Asimismo, el trabajador podrá solicitar el regreso a su jornada o modalidad contractual anterior, incluso cuando el periodo de adaptación acordado no hubiera terminado, si puede justificar un cambio en sus circunstancias. Habrá que esperar el impacto de dicha medida en la organización de las empresas y las primeras sentencias para conocer los criterios que apliquen los jueces para decidir si prevalecen las necesidades del trabajador o las necesidades organizativas o productivas de la empresa.
