[value] => Ist ein Arbeitgeber (1) rechtlich und tatsächlich mit einem anderen Arbeitgeber (2) verbunden und schließt ein zuvor bei dem einen Arbeitgeber (1) zeitlich befristet angestellter Arbeitnehmer mit dem anderen Arbeitgeber (2) einen sachgrundlos befristeten Arbeitsvertrag ab, kann eine rechtsmissbräuchliche Umgehung der gesetzlichen Bestimmungen zur sachgrundlosen Befristung vorliegen.
So bewertete das Landesarbeitsgericht Berlin-Brandenburg den Fall einer Arbeitnehmerin einer Labor-Arbeitsgruppe (Urt. v. 31.01.2019, Az. 21 Sa 936/18). Das Labor wird in einem Forschungsverbund gemeinschaftlich von zwei Trägern betrieben, von denen einer die Arbeitnehmerin sachgrundlos auf zwei Jahre befristet beschäftigt hatte. Nach Ablauf der Befristung erhielt die Arbeitnehmerin erneut einen sachgrundlos befristeten Vertrag zu denselben Bedingungen und für denselben Arbeitsplatz in derselben Arbeitsgruppe diesmal jedoch mit dem anderen Träger des Forschungsverbunds als Arbeitgeber.
Nach Ansicht der Berliner Arbeitsrichter war der Arbeitgeberwechsel durch den Leiter der Arbeitsgruppe initiiert und schließlich nur vorgenommen worden, um eine ansonsten unzulässige erneute Befristung zu ermöglichen. Darin sah das LArbG eine rechtsmissbräuchliche Umgehung des sog. Anschlussverbots aus § 14 Abs. 2 Satz 2 TzBfG (Teilzeitbefristungsgesetz) und entschied auf Entfristung des Vertrages.
Auf eine etwaige Bösgläubigkeit der Arbeitnehmerin kam es hier nicht an, denn bei einer rechtsmissbräuchlichen Umgehung des Anschlussverbots gehe es nicht um die Ausnutzung der Unerfahrenheit oder des mangelnden Wissens der anderen Vertragspartei, sondern darum, dass der Arbeitnehmerin oder dem Arbeitnehmer entgegen der gesetzlichen Wertung anstelle eines unbefristeten Arbeitsvertrags lediglich ein sachgrundlos befristeter Arbeitsvertrag angeboten wird, so das Landesarbeitsgericht.

[value] => Cuando existe un vínculo entre dos empleadores, y un empleado, previamente contratado por el empleador (1) con un plazo limitado, celebra luego otro contrato de trabajo temporal con el otro empleador (2), puede haber una elusión abusiva de las disposiciones legales respecto a los contratos de trabajo de duración determinada sin causa justificada (prohibición de encadenar contratos temporales).
El Tribunal del Trabajo de la región de Berlín-Brandemburgo evaluó el caso de una empleada de un grupo de trabajo de laboratorio (sentencia de 31.01.2019, expediente nº 21 Sa 936/18). El laboratorio opera como asociación de investigación y consiste en dos empresas, una de las cuales había contratado a la empleada por un plazo limitado sin causa justificada de dos años. Al final del plazo, la empleada recibió de nuevo un contrato de duración determinada sin causa justificada con los mismos términos y condiciones y para el mismo lugar de trabajo en el mismo grupo de trabajo, pero esta vez contratada por la otra empresa de investigación como empleador.
Según la opinión de los jueces del tribunal de trabajo, el cambio de empleador fue iniciado por el jefe del grupo de trabajo y finalmente sólo se llevó a cabo para permitir un nuevo contrato temporal sin causa justificada que con el mismo empleador hubiera sido inadmisible. El Tribunal del Trabajo consideró que se trataba de una elusión abusiva de la llamada prohibición de temporalidad encadenada, según la frase 2 del apartado 2 del artículo 14 de la Ley de Limitación de Tiempo Parcial Alemán, y decidió levantar la temporalidad, es decir, convirtió el contrato en indefinido.
En este caso, la mala fe de la trabajadora no tiene importancia, ya que, en caso de elusión abusiva de la prohibición de conexión, no se trata de explotar la inexperiencia o el desconocimiento de la otra parte contratante, sino simplemente de ofrecer al trabajador un contrato de trabajo de duración determinada sin causa, en lugar de un contrato de trabajo indefinido, contrariamente a la valoración jurídica, según el Tribunal del Trabajo.
