[value] => 1. Die Entscheidung des EuGH
Nach der Entscheidung des EuGH vom 14.5.2019 – C-55/18 ist eine nationale Rechtslage mit der EU-Charta unvereinbar, insoweit der Arbeitgeber hierin nicht verpflichtet ist, ein System einzurichten, mit dem die täglich geleistete Arbeitszeit eines jeden Arbeitnehmers gemessen werden kann. Der Gerichtshof untermauert die Bedeutung des der EU-Charta immanenten Rechts eines jeden Arbeitnehmers auf die Begrenzung der Höchstarbeitszeit sowie der täglichen und wöchentlichen Ruhezeiten.
2. Nationale Rechtslage in Deutschland
In Deutschland ist die Dokumentationspflicht der Arbeitszeit bislang allenfalls lückenhaft ausgestaltet. So sieht § 16 Abs.2 ArbZG lediglich eine Pflicht zur Dokumentation solcher Arbeitsstunden vor, die die Regelarbeitszeit von 8 Stunden pro Tag überschreiten. Dies wird den seitens des EuGH neuerlich hervorgehobenen Vorgaben einer flächendeckenden Arbeitszeiterfassung nicht standhalten. Das Urteil entfaltet keine unmittelbare Drittwirkung gegenüber Arbeitgebern, sondern verpflichtet den Gesetzgeber zur Transformation in nationales Recht. Da das Urteil weder rechtsersetzende Wirkung entfaltet, noch eine konkrete Umsetzungsfrist gesetzt wurde, fragt sich nach dessen unmittelbarer Auswirkung in der nationalen Rechtsanwendung.
3. Möglichkeiten des Betriebsrates
Die neuerliche EuGH Rechtsprechung könnte die Betriebsräte als innerbetriebliche Arbeitnehmervertretung auf den Plan rufen. Sieht das Betriebsverfassungsrecht in einer Angelegenheit ausdrücklich ein Mitbestimmungsrecht für den Betriebsrat vor, hat dieser gegenüber dem Arbeitgeber auch ein erzwingbares Initiativrecht. Nach § 87 Abs. 1 Nr. 1 - 13 BetrVG gilt dies insbesondere für soziale Angelegenheiten, wie zum Beispiel Arbeitszeitregelungen und deren Erfassung. Es bleibt abzuwarten, wie die nationale Rechtsprechung auf eine entsprechende Vorlage reagieren würde. Die rechtlichen Strukturen für ein initiierendes Tätigwerden der Betriebsräte zur Einrichtung von Arbeitszeiterfassungssystemen bestehen allerdings - zumal die Auslegung nationalen Rechts nunmehr anhand der EuGH Rechtsprechung zu erfolgen hat.

[value] => 1. Sentencia del TJUE
Según la sentencia del TJUE de 14 de mayo de 2019 (asunto C-55/18), existe a nivel nacional una vulneración de la Carta Europea cuando los Estados miembros no imponen a los empresarios la obligación de implantar un sistema objetivo, fiable y accesible que permita computar la jornada laboral diaria realizada por cada trabajador. El Tribunal destaca la importancia del derecho de cada trabajador, incorporado en la Carta europea, a la limitación de las horas máximas de la jornada y los períodos de descanso diarios y semanales.
2. Situación legal en Alemania
En Alemania, la obligación de registrar la jornada laboral está actualmente regulada de manera incompleta. Por ejemplo, § 16 ArbZG (Ley de la jornada laboral) sólo establece la obligación de registrar las horas extraordinarias, es decir, las horas que superen el tiempo de jornada normal de 8 horas diarias. Como registro completo de la jornada esto es insuficiente, subrayado recientemente por el TJUE. La sentencia del TJUE no tiene ningún efecto directo para los empresarios, sino que obliga a las autoridades legislativas a transformarla en una ley nacional. Como la sentencia no reemplaza las leyes nacionales ni ha fijado ningún plazo concreto para su transposición, se puede poner en duda el efecto concreto sobre su aplicabilidad en el derecho nacional.
3. Posibilidades de los comités de empresa
La reciente jurisprudencia del TJUE podría llamar la atención a los comités de empresa, siendo estos los órganos internos de representación de los empleados. Ya que la Ley de Comités de empresas (BetrVG) prevé expresamente un derecho de iniciativa para el comité de empresa, puede ejercer ese derecho impositivo frente al empresario. Según § 87 Apart. 1 Núm. 1 - 13 BetrVG esto se aplica especialmente en los asuntos sociales, como por ejemplo, la regulación del tiempo de la jornada y su registro. Queda por ver cómo reaccionará la jurisprudencia nacional en caso de litigio. Sin embargo, ya existen las estructuras jurídicas para que los comités de empresa tomen la iniciativa en la creación de sistemas de registro de la jornada laboral – y en particular, el derecho nacional debe interpretarse a partir de la sentencia conforme a la jurisprudencia del TJUE.
