[value] => Die Absage einer Veranstaltung der Größenordnung wie der Mobile World Congress (MWC) in Barcelona führt zu erheblichen wirtschaftlichen Verlusten für die Unternehmen. Es stellt sich die Frage, ob diese Verluste geltend gemacht werden können.
Zu bedenken ist, dass sich nicht alle betroffenen Unternehmen in der gleichen Situation befinden. Einerseits gibt es Unternehmen, die ihre Produkte und Neuheiten auszustellen gedachten und andererseits die Teilnehmer, die Flüge bezahlt haben, Hotels mit stornierten Reservierungen, Restaurants mit gewissen Einkommenserwartungen, Taxifahrer usw. Sie alle fragen sich, ob sie Ansprüche haben, gegen wen und auf welche Weise. Diejenigen, die einen tatsächlichen und effektiven Schaden erlitten haben, können einen Anspruch geltend machen, der von Fall zu Fall analysiert werden müsste, da z.B. ein Aussteller, der für ein Produkt werben wollte, nicht a priori einen Verlust des tatsächlichen Verkaufsgewinns, der während der MWC hätten erzielt werden können, geltend machen kann, da dieser Anspruch auf Vermutungen beruht. Auch könnte man die erwarteten Gewinne aus Hotelreservierungen oder Standbuchungen geltend machen. Zur Frage, gegen wen die Ansprüche geltend gemacht werden sollen, könnte man sagen, dass das Unternehmen, welches die MWC storniert hat, die Kosten für den verursachten Schaden zu übernehmen hätte, was von Fall zu Fall geprüft werden müsste durch Analyse jedes einzelnen von den Geschädigten unterzeichneten Vertrages auf etwaige Straf- oder Rücktrittsklauseln. Zur Klärung, wie ein Anspruch geltend gemacht werden kann und nach Ausräumung der vorherigen Zweifel, sollten die Verträge erneut analysiert und hinsichtlich spezieller Mediations- und Schiedsklauseln geprüft werden, um den jeweils geeignetsten Weg abzuwägen.
Fazit: Die Ausgangsfrage lässt keine rigorose Antwort zu, da von Fall zu Fall die konkreten Schäden zu untersuchen sind, gegen wen wir die Ansprüche geltend machen wollen und wie sie geltend gemacht werden können.

Ahora bien, la pregunta es si se pueden reclamar dichas pérdidas económicas. Sin embargo, hay que tener en cuenta que no todas las empresas perjudicadas se encuentran en la misma situación. Por un lado, están las empresas que pensaban exponer sus productos y novedades, y por otro lado, los asistentes que hayan desembolsado el pago de vuelos, los hoteles que vean canceladas las reservas, los restaurantes que tenían unas expectativas de ingresos, los taxistas, etc. Todos ellos se preguntan si pueden reclamar, a quién y de qué manera.
Primeramente, podrían reclamar aquellas personas que hayan sufrido un perjuicio real y efectivo, sin embargo habría que analizar caso por caso porque, por ejemplo, un expositor que iba a promocionar algún producto, no podría a priori reclamar una pérdida real de beneficio por las ventas que pudiera obtener durante el MWC, entendiendo que la reclamación se basa en suposiciones. Por otro lado, sí que cabría la posibilidad de reclamar los beneficios esperados por reservas hoteleras o por reservas del stand en el MWC.
En cuanto a la pregunta de a quién habría que reclamar podríamos decir que a priori debería hacerse la reclamación a la empresa GSMA quien ha cancelado el MWC y quien sería la responsable de asumir los gastos por los daños causados, pero sin embargo habría que analizar cada contrato firmado por los perjudicados, y en concreto las cláusulas penales o resolutorias que pudiera haber.
Por último, surge la pregunta cómo reclamar. Una vez se hayan resuelto las dudas anteriores habría que analizar nuevamente los contratos en el sentido de ver si hay cláusulas especiales de mediación y arbitraje para poder valorar la vía más adecuada en cada caso.
Conclusión: Como se puede ver, no se puede dar con rigor una respuesta clara a la pregunta inicial, ya que habrá que estudiar caso por caso de qué daños estamos hablando, frente a quién se pretende reclamar y cómo reclamar.
