[value] => Im vergangenen Jahr musste sich das spanische Juwelierunternehmen “Tous” gegen die Anklage der Staatsanwaltschaft wegen der Verbrechen der irreführenden Werbung, des fortgesetzten Betrugs, der Dokumentenfälschung und der Korruption im Geschäftsleben, die von dem spanischen Verbraucherverband von Schmuckstücken Consujoya initiiert wurde, vor dem spanischen Nationalen Gerichtshof verteidigen.
Die Frage, die sich stellte, war, ob Silberschmuck, der durch die “Electroforming”-Technik (Schmuckstücke, die im Inneren eine nichtmetallische Komponente aufweisen) hergestellt wird und dessen Außenseite aus Sterlingsilber besteht, als Edelmetall bezeichnet werden können.
Der spanische Verband der Juweliere, Silberschmiede und Uhrmacher unterstützte die Firma Tous während der Befragung vor dem Richter und sagte aus, dass es sich um eine interne Herstellungstechnik handelt, die es ermöglicht, dem Verbraucher Designschmuckstücke zu einem erschwinglicheren Preis anzubieten.
Gemäss Artikel 55 des Gesetzes über Gegenstände aus Edelmetallen kann ein Schmuckstück als Edelmetall bezeichnet werden, obwohl nichtmetallische Materialien verwendet werden, um den Produkten aus Edelmetall Stabilität zu verleihen, Die nichtmetallischen Materialien dürfen jedoch nicht gefärbt oder beschichtet werden, um ihnen das Aussehen von Edelmetall zu verleihen.
Der spanische Nationale Gerichtshof hat am 27. Januar 2020 beschlossen, dass kein Betrugsfall vorliegt, da die verkauften Stücke ohne jegliche Täuschung als Edelmetalle angesehen werden und dem Verbraucher zu keinem Zeitpunkt das Tousprodukt als massives Silber verkauft wird. Darüber hinaus besagt das Echtheitszertifikat, dass der Schmuck einen nichtmetallischen Kern enthalten kann, um Stabilität zu gewährleisten.
Auch gäbe es keine irreführende Werbung, da im Angebot der Produkte keine falschen Behauptungen oder unsicheren Eigenschaften zu finden sind. Ebenso wenig habe man es mit einem Verbrechen der falschen Dokumentation zu tun, da die ausgestellten Echtheitszertifikate im Einklang mit den Vorschriften für Edelmetalle stünden. Es gäbe auch kein Verbrechen der Korruption unter Privatpersonen.
Obwohl der Fall Tous eingestellt wurde, bleibt der Reputationsschaden für die Firma bestehen.
In Spanien gibt es mehrere Möglichkeiten des Rechtsschutzes für Fälle von Angriffen auf den Ruf von Unternehmen, welches ein Grundrecht auf Ehre, persönliche und familiäre Privatsphäre sowie des Selbstbildes darstellt, dass nicht nur natürliche Personen, sondern auch juristische Personen schützen.
Die Marke untersucht nun die Erfolgsaussichten einer möglichen Klageerhebung gegen den Verbraucherverband Consujoya wegen unlauteren Wettbewerbs und Missbrauchs der Figur der Volksanklage.

[value] => El año pasado, la firma española de joyería “Tous” se tuvo que defender ante la Audiencia Nacional tras una acusación del Ministerio Fiscal por los delitos de publicidad engañosa, estafa continuada, falsedad en documento y corrupción en los negocios, iniciada por Consujoya, la Asociación Española de Consumidores y Usuarios de Joyas.
La cuestión planteada versaba sobre si las joyas de plata elaboradas empleando la técnica “electroforming”, joyas en cuyo interior existe un componente no metálico y cuyo exterior está hecho de plata de primera ley, podían considerarse como metal precioso.
La Asociación Española de Joyeros, Plateros y Relojeros apoyó durante su interrogatorio celebrado ante el juez a la compañía Tous y testificó que se trata de una técnica propia de fabricación que permite ofrecer al consumidor joyas con más diseño a un precio más asequible.
Según el artículo 55 de la Ley de objetos fabricados con metales preciosos, una pieza de joyería puede considerarse metal precioso, aunque se utilizen materiales no metálicos, por conferir estabilidad en objetos fabricados con metales preciosos, pero los materiales no metálicos no pueden colorearse ni recubrirse para darles apariencia de metales preciosos.
La Audiencia Nacional española decidió el 27 de enero de 2020 que no había ningún caso de fraude, ya que las piezas vendidas se consideran metales preciosos sin ningún tipo de engaño y en ningún caso la joya Tous se vende al consumidor como plata maciza. Además, el certificado de autenticidad establece que la joya puede contener un núcleo no metálico para garantizar la estabilidad.
Tampoco existiría publicidad engañosa, pues en la oferta de los productos no se constatan alegaciones falsas o características inciertas. Asimismo, no estamos ante un delito de falsedad documental, puesto que la certificación cumple con el Reglamento de metales preciosos. Tampoco existe un delito de corrupción entre particulares.
Aunque el caso de Tous ha sido archivado, el daño a su reputación permanece.
En España existen varias vías de protección legal para casos de ataques a la reputación de empresas, la cual constituye el derecho fundamental al honor, a la intimidad personal y familiar y a la propia imagen, que protege no solo a las personas físicas, sino también a las personas jurídicas.
La marca está estudiando las posibilidades de éxito de una demanda contra Consujoya por competencia desleal y abuso de la figura de acusación popular.
