[value] => Die Schiedsgerichtsbarkeit, die unter den Oberbegriff Alternative Dispute Resolutions fällt, hat in letzter Zeit als Methode zur Beilegung von Handelsstreitigkeiten einen erheblichen Aufschwung erfahren. Die Flexibilität des Verfahrens hat dazu geführt, dass dieser Mechanismus im internationalen Handelsbereich an Bedeutung gewonnen hat. Neben den Vorteilen, die die Parteien möglicherweise zu schätzen wissen, wenn sie ihre Vertragsbeziehung einer Schiedsklausel unterwerfen, hat die Schiedsgerichtsbarkeit aber auch ihre Schwächen, zu denen die mangelnde Unparteilichkeit des Schiedsrichters gehören kann. Daher werden in den Fällen, in denen eine solche Unparteilichkeit festgestellt wird, die Schiedssprüche aufgehoben.
Das Schiedsgerichtsgesetz von 2003 betont die Bedeutung der Unparteilichkeit und Unabhängigkeit des Schiedsrichters: “die Pflicht aller Schiedsrichter, unabhängig davon, wer sie ernannt hat, die gebührende Unparteilichkeit und Unabhängigkeit gegenüber den Parteien des Schiedsgerichtsverfahrens zu wahren. Um dies zu gewährleisten ist es ihre Pflicht, den Parteien alle Fakten oder Umstände offenzulegen, die ihre Unparteilichkeit oder Unabhängigkeit in Frage stellen könnten”. Aber was geschieht in Fällen, in denen ein offensichtlich parteilicher Schiedsspruch ohne vorherige Anfechtung durch die Parteien erlassen wird? Im Einklang mit der aktuellen Rechtsprechung der Obersten Gerichte wird der Schiedsspruch null und nichtig sein, womit den Parteien die Möglichkeit eröffnet wird, entweder eine neue Schiedsvereinbarung mit allen Garantien zu unterzeichnen oder ein ordentliches Gerichtsverfahren einzuleiten. Eine solche Nichtigkeit beruht auf der Übertragung einer Staatsgewalt, in Form der Justizgewalt, auf die Schiedsgerichte, so dass bei der Ausübung dieser Gewalt der Gleichheitsgrundsatz das Leitkriterium sein muss. Aus diesem Grund sind offensichtlich parteiische Schiedssprüche null und nichtig, da diese gegen den verfassungsmäßigen Grundsatz der Gleichheit verstoßen.

[value] => El arbitraje, que se encuadra bajo el genérico término Alternative Dispute Resolutions,ha experimentado en los últimos años un importante crecimiento como método de resolución de las disputas comerciales. La flexibilidad en el procedimiento ha hecho que este mecanismo haya ido ganando peso en el panorama comercial internacional. Sin embargo, y paralelamente a las ventajas que las partes puedan apreciar a la hora de someter su relación a una cláusula arbitral, lo cierto es que el arbitraje presenta también sus puntos débiles dentro de los cuales se enmarca la falta de imparcialidad por parte del árbitro. Tal es así, que en aquellos supuestos en los que se aprecie tal parcialidad, se procederá a la anulación de los laudos arbitrales.
La Ley de Arbitraje de 2003 hace hincapié sobre la importancia de la imparcialidad e independencia del árbitro: “el deber de todos los árbitros, al margen de quien los haya designado, de guardar la debida imparcialidad e independencia frente a las partes en el arbitraje. Garantía de ello es su deber de revelar a las partes cualquier hecho o circunstancia susceptible de poner en duda su imparcialidad o independencia”. ¿Pero, qué sucede en los supuestos en los que se dicta laudo manifiestamente parcial sin haber procedido las partes a la recusación previa? Pues, atendiendo a la jurisprudencia actual de los Tribunales Superiores de Justicia, procederá la nulidad de lo dictado, lo cual abre la posibilidad a las partes bien de suscribir un nuevo convenio arbitral con todas las garantías o bien de acudir a la vía jurisdiccional ordinaria. Tal nulidad se fundamenta, precisamente, en la cesión de un poder estatal, como es la potestad jurisdiccional, a las Cortes Arbitrales, de manera que en el ejercicio de tal facultad deberá figurar el principio de igualdad como criterio rector. Por ello, procederá la nulidad de los laudos dictados con manifiesta parcialidad, dado que se producirá una quiebra en el principio constitucional de igualdad.
