[value] => Seit Januar 2016 hat in Spanien jegliche Kommunikation zwischen Juristen (Anwälte, Gerichtsvertreter) und Gerichten über eine Internet-Plattform zu erfolgen, die das spanische Justizministerium in Gang gesetzt hat, und die sich LexNet nennt. Das heißt, alle Schriftsätze (Klagen, Klagebeantwortungen, Anlagen, Anträge, Rechtsmittel) sind auf elektronischem Wege einzureichen. Gleichermaßen müssen auch alle Entscheidungen und Mitteilungen der Gerichte auf diesem Weg zugestellt werden. All dies mit dem Ziel, das Justizwesen zu modernisieren und zu digitalisieren.
Das ehrgeizige Projekt versagte von Anfang an: Nicht alle Gerichte verfügten über die erforderlichen IT-Werkzeuge und es gab keine ausreichende Schulung für den Umgang mit der Online-Plattform. Es gibt auch heute noch in einigen Provinzen Gerichte, die nicht mit diesem System operieren.
Und im Laufe der Zeit haben sich zusätzliche Probleme herausgestellt: Schriftsätze, deren Einreichung dem Absender bestätigt wird, aber den Empfänger nicht erreichen; Mitteilungen, die nicht ankommen, u.s.w., wodurch das Recht auf effektiven Rechtsschutz und auf einen fairen Prozess gefährdet wird.
Im Sommer dieses Jahres traten wiederum neue Probleme auf, dieses Mal im Zusammenhang mit der Sicherheit des Systems: Nach einer im Juli vorgenommenen Aktualisierung konnte jeder Systemnutzer die persönlichen Ordner jedes anderen Systemnutzers einsehen, das heißt, alle Schriftsätze, Dokumente, u.s.w, die von einem anderen Systemnutzer eingereicht worden waren, sowie alle Mitteilungen des Gerichts.
Es sind in diesem Zusammenhang verschiedene Maßnahmen eingeleitet worden, unter anderem seitens der spanischen Agentur für Datenschutz. Es bleibt abzuwarten, ob das spanische Justizministerium, welches für die Plattform verantwortlich ist, schließlich sanktioniert wird, oder ob zumindest die Sicherheit und das korrekte Funktionieren des Systems für gerichtliche Kommunikationen, welches höchst vertraulich sein muss, garantiert wird.

[value] => Desde enero de 2016 todas las comunicaciones que realizan los operadores jurídicos con los juzgados (Abogados, Procuradores, Graduados sociales) deben realizarse de forma telemática a través de una plataforma en Internet puesta en funcionamiento por el Ministerio de Justicia, denominada LexNet. Es decir, todos los escritos a presentar en un juzgado (demandas, contestaciones, anexos, escritos de alegaciones, recursos) debían presentarse de forma telemática. También las notificaciones de los juzgados se iban a recibir a través de esa misma vía. Todo ello, enmarcado dentro del objetivo del Gobierno de modernizar y digitalizar la justicia.
Desde el primer momento el ambicioso proyecto empezó a fallar: No todos los juzgados disponían de las herramientas informáticas necesarias, no se dio formación suficiente a los funcionarios para manejar dicha plataforma. A día de hoy, aun hay órganos jurisdiccionales en algunas provincias en los que no se encuentra operativo el sistema.
Y en este tiempo se han detectado importantes problemas en su funcionamiento: Escritos que constan como presentados al remitente pero no al destinatario, notificaciones que no se reciben, etc., que no hacen sino poner en peligro el derecho a la tutela judicial efectiva y a un proceso con todas las garantías.
Este verano, además, se han detectado nuevos problemas en el sistema, esta vez relacionados con la seguridad: Tras una actualización durante el pasado mes de julio, cualquier usuario pudo acceder a la carpeta personal de cualquier otro usuario del sistema. Es decir, a los escritos, documentos, etc. presentados por cualquier usuario y a las notificaciones recibidas del juzgado.
Ya están tramitándose diversas actuaciones al respecto, entre otras por la Agencia Española de Protección de Datos. Veremos si el Ministerio de Justicia – responsable de la plataforma - es finalmente sancionado o si, al menos, se garantiza la seguridad y el buen funcionamiento de un sistema de comunicaciones judiciales que, como es lógico, es altamente confidencial.
