[value] => Am 23. Mai 2017 hat der 2. Senat des Obersten Gerichtshofs im Zuge einer Verständigung das bislang auf dem Gebiet des Strafrechts kontrovers diskutierte Verhältnis zwischen dem Vorschuss, der an Wohnungsbauträger gezahlt wird, und dem Straftatbestand der rechtswidrigen Aneignung entschieden.
Geklärt wurden die strafrechtlichen Folgen für Wohnungsbauträger bei Verletzung der im spanischen Bauordnungsgesetz in der Fassung des Gesetzes über die Regulierung, Kontrolle und Zahlungsfähigkeit der Versicherungsgesellschaften vorgesehenen Pflichten.
Der 2. Senat des Obersten Gerichtshofs führt aus, dass im Falle von an die Bauträger gezahlten Vorschüssen allein die Verletzung von sich aus der ersten Zusatzbestimmung des spanischen Bauordnungsgesetzes vom 5. November 1999 („Ley 38/1999, de 5 de noviembre, de Ordenación de la Edificación“), in der Fassung des Gesetzes vom 14. Juli 2015. ergebenden Pflichten, insbesondere die Verletzung der Pflicht zum Abschluss einer Zahlungsausfallversicherung für den Fall, dass mit den Bauarbeiten nicht begonnen oder diese nicht zu Ende geführt werden, nicht den Tatbestand einer rechtswidrigen Aneignung darstellt.
Ferner wird festgelegt, dass eine Strafbarkeit als Betrug nur dann in Betracht kommt, wenn der Bauträger Gelder, die zum Bau von Wohnungen bereitgestellt wurden, nicht zum Wohnungsbau verwendet und die konkurrierenden Voraussetzungen des Straftatbestandes eines Betruges, einer unlauteren Verwaltungshandlung gemäß Art. 252 des spanischen Strafgesetzes oder einer rechtswidrigen Aneignung gemäß Art. 253 des spanischen Strafgesetzes vorliegen.

[value] => El Pleno no jurisdiccional de la Sala Segunda del Tribunal Supremo con fecha 23 de mayo de este año ha alcanzado un acuerdo por el que resuelve una cuestión hasta ahora controvertida en el ámbito penal. Con este acuerdo queda determinado el alcance que respecto de la comisión del delito de apropiación indebida, tiene el anticipo para la construcción a los promotores de viviendas de cantidades dinerarias.
Quedan así determinadas de manera clara las conconsecuencias penales que para los promotores de viviendas tiene el incumplimiento de las obligaciones establecidas para los promotores por Ley de Ordenación de la Edificación en la redacción dada por la Ley de ordenación, supervisión y solvencia de las entidades aseguradoras y reaseguradoras.
En concreto, en la misma se establece que en el caso de cantidades anticipadas a los promotores para la construcción de viviendas, el mero incumplimiento, por sí solo, de las obligaciones previstas en la Disposición Adicional Primera de la Ley 38/1999, de 5 de noviembre, no constituye una actuación delictiva encuadrable en el delito de apropiación indebida. En dicha disposición de Ordenación de la Edificación, en la redacción dada por la Ley 20/2015, de 14 de julio, se detalla que será necesario garantizar mediante un seguro la devolución de dichas cantidades en aquellos casos en los que la construcción no se llegue a iniciar o ésta no llegue a buen fin, y que esas cantidades se percibirán a través de una cuenta especial en entidades de crédito.
En este mismo acuerdo se señala también que cuando las cantidades entregadas a los promotores no se hayan destinado a la construcción de las viviendas comprometidas con los adquirentes, se podrá apreciar un delito de estafa, siempre y cuando concurran los elementos del tipo del delito, entre ellos el engaño determinante del acto de disposición, o bien un delito de administración desleal del artículo 252 del Código Penal o de apropiación indebida del artículo 253 del Código Penal.
