[value] => Artikel 5 des Körperschaftsteuergesetzes verfügt für den konkreten Fall der Vermietung von Immobilien, dass diese Tätigkeit dann einer Wirtschaftstätigkeit entspricht, wenn für deren Verwaltung mindestens ein Angestellter mit Vollzeitbeschäftigungsvertrag in Anspruch genommen wird.
Die Generaldirektion für Steuerangelegenheiten stellte in ihrer Rechtsauskunft V0660/2016 vom 17.02.2016, unter Berufung auf Artikel 3 des spanischen Zivilgesetzbuches, der besagt, dass „Rechtsnormen gemäß der eigenen Bedeutung ihrer Worte unter Berücksichtigung des Zusammenhangs, der historischen und gesetzlichen Vorgeschichte sowie der sozialen Wirklichkeit der Zeit, in der sie angewendet werden müssen, auszulegen sind, wobei vor allem Sinn und Zweck jener Gesetze zu beachten sind“, fest, dass die wirtschaftliche Realität unternehmerische Situationen aufzeigt, in denen eine Gesellschaft ein Immobilienvermögen besitzt, für dessen Verwaltung wenigstens eine angestellte Person erforderlich ist, womit die Gesellschaft zwar einer Tätigkeit gemäß Art. 5 des Körperschaftsteuergesetzes nachgehen würde, diese Voraussetzung jedoch durch die Untervergabe dieser Verwaltungsaufgaben an andere Gesellschaften ersetzt wird.
Aus diesem Grund kommt die Generaldirektion für Steuerangelegenheiten zu dem Schluss, dass es für die Feststellung, ob die von einer Gesellschaft betriebenen Mietgeschäfte einer Wirtschaftstätigkeit entsprechen, unerheblich ist, ob der genannten Tätigkeit mit eigenem Personal oder im Rahmen des Outsourcings mit Dritten, die sich des Managements und der Verwaltung der Immobilien annehmen, nachgegangen wird.

[value] => El artículo 5 de la LIS establece que en caso concreto del arrendamiento de inmuebles, dicha actividad tiene la condición de económica cuando para su ordenación se utilice, al menos, una persona empleada con contrato laboral y jornada completa.
La Dirección General de Tributos en su consulta número V0660/2016 de 17.02.2016 basándose en el artículo 3 del Código Civil que señala que “las normas se interpretarán según el sentido propio de sus palabras, en relación con el contexto, los antecedentes históricos y legislativos, y la realidad social del tiempo en que han de ser aplicadas, atendiendo fundamentalmente al espíritu y finalidad de aquéllas”, establece que la realidad económica pone de manifiesto situaciones empresariales en las que una entidad posee un patrimonio inmobiliario, para cuya gestión se requiere al menos una persona contratada, realizando la entidad una actividad económica en los términos del artículo 5 de la LIS y, sin embargo, ese requisito se ve suplido por la subcontratación de esa gestión a otras Sociedades.
Por ello, la Dirección General de Tributos concluye que para determinar si la actividad arrendaticia desarrollada por una Sociedad constituye una actividad económica, resulta irrelevante que dicha actividad se realice con personal propio o con medios que están externalizados con un tercero que se encarga de la gestión y administración de los inmuebles.
