[value] => Der Bundesgerichtshof (BGH) hat sich bereits in einer Vielzahl von Entscheidungen geäußert, inwieweit Instandhaltungspflichten, insbesondere Schönheitsreparaturen im Rahmen von Mietverträgen auf den Mieter abgewälzt werden können. Nach dem gesetzlichen Leitbild handelt es sich bei den Instandhaltungspflichten, die die Durchführung von Schönheitsreparaturen umfassen, um eine sog. Kardinalspflicht des Vermieters, so dass der Abwälzung auf den Mieter, insbesondere in Form von Allgemeinen Geschäftsbedingungen enge Grenzen gesetzt sind.
Nicht zuletzt im Jahr 2015 hatte der Bundesgerichtshof mehrere Klauseln für unwirksam erklärt, mit denen der Mieter zur Durchführung von Schönheitsreparaturen verpflichtet werden sollte. Diese zum Wohnraummietrecht ergangene Rechtsprechung wird nach und nach auch auf das Gewerberaummietrecht übertragen. Diese strengen Anforderungen haben einen Vermieter offensichtlich dazu bewogen, die Durchführung von Schönheitsreparaturen nicht auf den Mieter abzuwälzen, stattdessen aber zusätzlich zur Miete einen gesonderten Betrag in Höhe von EUR 79,09 monatlich als Aufschlag für Schönheitsreparaturen zu verlangen. Hiergegen wandte sich der Mieter und machte die Unwirksamkeit des Aufschlags geltend. Der BGH bestätigte in seiner Entscheidung (Beschluss vom 30. Mai 2017 / Az. VIII ZR 31/17) die Wirksamkeit der Regelung und machte deutlich, dass es sich hierbei um eine der Überprüfung durch die Gerichte grundsätzlich entzogene Frage der Vergütungsabrede zwischen den Parteien handelte. Der Vermieter hätte auch einfach eine höhere (Gesamt-)Miete verlangen können, ohne seine Kalkulation des Betrags für die Schönheitsreparaturen offenzulegen. Die Entscheidung dürfte im Wesentlichen unstreitig sein. Gleichwohl zeigt sie, dass das Thema Schönheitsreparaturen noch immer nicht als abgeschlossen betrachtet werden kann.

[value] => El Tribunal Supremo alemán (“Bundesgerichtshof”) ha expresado ya en numerosas decisiones hasta qué punto son transferibles al arrendatario las obligaciones de mantenimiento y, en particular, las de reparaciones cosméticas en los contratos de alquiler. La ley exige al arrendador el cumplimiento de las obligaciones de mantenimiento, y en particular, las obligaciones de reparaciones estéticas, tratándose una obligación esencial. Por ello, cuando se trata de un contrato sujeto a condiciones generales de contratación, el margen de traspaso de esta obligación al arrendatario es muy limitado.
Desde el año 2015 el Tribunal Supremo ha declarado nulas varias cláusulas en las que se transfería al inquilino la obligación de ejecución de reparaciones cosméticas. Esta jurisprudencia de los contrato de alquiler de vivienda se ha venido equiparando de forma gradual a los contratos de arrendamiento de espacios comerciales. Los estrictos requerimientos llegaron al conocimiento de un propietario, quien decidió no trasladar la obligación de realizar las reparaciones cosméticas al arrendatario, en su lugar, los realizaba el propio arrendador y le cobraba al arrendatario, además de renta, una cantidad adicional de 79,09 euros al mes en concepto de pago de las reparaciones cosméticas. El arrendatario se negó, alegando la nulidad de la cláusula. El Tribunal Supremo confirmó en su decisión (decisión de 30 de mayo de 2017 \/ AZ. ) VIII ZR 31\/17) la validez de esa cláusula y dejó claro que formaba parte del acuerdo de determinación de la renta, básicamente fuera de la revisión que puedan hacer los tribunales. Lo justifica diciendo que al propietario le hubiera bastado con haber incluido ese importe en la renta (total), sin tener que desglosar de su cálculo del importe destinado a las reparaciones cosméticas. Aunque se trata de una decisión no recurrible, parece que el tema de las reparaciones cosméticas aún no ha finalizado.
