[value] => Im vergangenen Juli veröffentlichte das spanische Institut für Rechnungswesen und Wirtschaftsprüfung (ICAC) zwei neue Rechtsauskünfte zum Rechnungswesen im BOICAC 110.
Beide Rechtsauskünfte beziehen sich auf die Änderungen, die durch den königlichen Erlass RD 602/2016 vom 2. Dezember zur Änderung des Allgemeinen Kontenrahmens (PGC), des Kontenrahmens für KMU (PGC-PYMES), der Vorschriften zur Aufstellung von konsolidierten Jahresabschlüssen (NFCAC) und der Vorschriften zur Anpassung des Allgemeinen Kontenrahmens an gemeinnützige Einrichtungen eingeführt wurden.
Rechtsauskunft 1 behandelt die Frage, ob die für die verkürzten Anhänge zum Jahresabschluss sowie für die Anhänge zum Jahresabschluss der KMU eingeführte Änderung ebenfalls für gemeinnützige Einrichtungen gilt. Das ICAC kommt zu dem Schluss, dass gemeinnützige Einrichtungen in jedem Fall weiterhin die im königlichen Erlass RD 1491/2011 vom 24. Oktober geforderten Angaben machen müssen und dass in Bezug auf die im PGC und im PGC-PYMES vorgesehenen allgemeinen Informationen für gemeinnützige Einrichtungen die gleichen Vereinfachungen gelten, die durch das RD 602/2016 vom 2. Dezember für die anderen Gesellschaften beschlossen wurden.
Die Rechtsauskunft 2 bezieht sich auf die Änderung bei der Bestimmung der Schwellenwerte für die Aufstellung von verkürzten Jahresabschlüssen, für die die Werte aller Konzerngesellschaften berücksichtigt werden müssen, es sei denn, dass der Jahresabschluss der Gesellschaft in den Konzernabschluss der beherrschenden Gesellschaften einbezogen wird. Im Einzelnen geht es um zwei Präzisierungen dieser Ausnahme für Gesellschaften, die konsolidierte Abschlüsse aufstellen. Das ICAC kommt zu dem Schluss, dass die beherrschende Gesellschaft für die Anwendung der Ausnahme ihren Sitz in Spanien oder einem sonstigen Mitgliedstaat der Europäischen Union haben muss und dass der konsolidierte Jahresabschluss derjenige einer Zwischenstufe der Unternehmensgruppe sein kann.

Ambas consultas están relacionadas con las modificaciones introducidas por el Real Decreto 602/2016, de 2 de diciembre, por el que se modifican el Plan General de Contabilidad (PGC), el Plan General de Contabilidad de Pequeñas y Medianas Empresas (PGC-PYMES), las Normas para la Formulación de Cuentas Anuales Consolidadas y las Normas de Adaptación del Plan General de Contabilidad a las entidades sin fines lucrativos.
La consulta 1 trata sobre si la modificación introducida en el modelo de memoria abreviada y de pequeñas y medianas empresas resulta de aplicación a las entidades sin fines lucrativos. El ICAC concluye que las entidades sin fines lucrativos, en todo caso, deberán seguir suministrando la información específica regulada en las normas de adaptación aprobadas por el Real Decreto 1491/2011, de 24 de octubre y que, respecto a la información general contenida en el PGC y en el PGC-PYMES, les resultarán de aplicación las mismas simplificaciones que se han aprobado para las demás empresas por el RD 602/2016, de 2 de diciembre.
La consulta 2 se refiere a la modificación del modo de calcular los límites cuantitativos para la utilización de los modelos de cuentas anuales abreviadas, debiendo considerar los importes de todas las entidades del grupo, excepto si la información financiera de la empresa se integra en las cuentas anuales consolidadas de la entidad dominante, y plantea dos precisiones sobre la excepción para el caso de las empresas que presenten cuentas consolidadas. El ICAC concluye que la nacionalidad de la sociedad dominante debe ser española o de cualquier otro estado miembro de la Unión Europea y que las cuentas anuales consolidadas pueden ser las correspondientes a un nivel intermedio del grupo.
