Die Nachfrage wächst stetig, dank Airbnb, Homeaway etc. mit ihr auch das Angebot. Aber das Wachstum aufgrund der kurzfristigen privaten Zimmervermietung hat offenbar in bestimmten Städten und Inseln solche Ausmaße erreicht, dass bei den Einwohnern ein Gefühl wenn nicht der Eroberung, so doch der Belagerung entsteht, das nicht mehr durch die doch erheblichen positiven wirtschaftlichen Folgen des Tourismus entschädigt werden kann. Wie werde ich die Geister, die ich rief, nun wieder los – so fragen sich manche Bürgermeister und Comunidades Autónomas (CCAA). Rechtsgrundlage für lokale Abhilfe ist das Ley de Arrendamientos Urbanos (LAU) (Gesetz für städtische Mieten), das 2013 die kurzfristigen Mietverträge von dem gesetzlichen Regelungsumfang ausnahm und die Gesetzgebungskompetenz an die CCAA delegierte, die hiervon Gebrauch gemacht haben. Grundsätzlich gilt bei fast allen: der Anbieter muss sich in ein registro de turismo eintragen, die Eintragung ist je nach CCAA an die unterschiedlichsten Bedingungen geknüpft und nicht ohne weiteres zu erlangen. Die von manchen angestrebte Reduzierung des Tourismus durch die regionalen Vorschriften, insbesondere bei der privaten Vermietung via Internet, ist offenbar noch nicht an allen Orten eingetreten, wie Berichte aus diesem Sommer zeigen.
Wird die Lösung eine limitierte Lizenzvergabe sein wie etwa bei städtischen Taxis? Dienstleistungsfreiheit versus Regelungsbedarf ist weiterhin eine rechtlich interessante und tatsächlich relevante Debatte.

La demanda sigue creciendo, gracias a ofertas de alojamiento via internet como airbnb o homeaway. Pero, parece que el aumento del número de turistas en algunas islas y ciudades, que se alojan en pisos de alquiler, está llegando a tal extremo, que sus habitantes se sienten, si no conquistados, sí ya asediados, y los beneficios económicos a causa del turista - en un principio – invitado, ha dejado de ser una compensación a la incomodidad de los lugareños. ¿Cómo reaccionar? La Ley de Arrendamientos Urbanos (LAU) en 2013 excluyó de su ámbito el alquiler turistíco a corto plazo, cediendo la competencia de regulación a las CCAA. Éstas han aprovechado la ocasión, creando la mayoría de ellas registros de turismo de obligada inscripción, estando vinculada la inscripción a unos requisitos que varían mucho entre las CCAA. Viendo los acontecimientos de este verano, no parece que la regularización satisfaga a todos los habitantes. ¿Será la solución la concesión de un número máximo de licencias como en el caso de los táxis?
Libre prestación versus necesidad de regular el mercado (por razones medioambientales o de protección de sus habitantes). Encontrar un equilibrio que respete los intereses de todos los afectados sigue siendo un reto para los legisladores.
