[value] => Die EZB betreibt seit 2015 im Rahmen eines laufenden Kaufprogramms Anleihenkäufe in äußerst großem Umfang, an dem sich auch die Deutsche Bundesbank beteiligt, welche mit ca. 25% am eingezahlten Kapital größter EZB-Anteilseigner ist. Zur Ankurbelung von Inflation und Konjunktur kauft die Notenbank Staatsanleihen und andere Papiere in großem Stil - derzeit für 60 Milliarden Euro monatlich. Gegen dieses Kaufprogramm wurde nun Klage vor dem Bundesverfassungsgericht eingereicht. Diesem zufolge sollen wichtige Gründe dafür sprechen, dass die dem Anleihekaufprogramm zugrundeliegenden Beschlüsse gegen das Verbot der Staatsfinanzierung durch die Notenbank verstoßen. Sie gingen über das Mandat der EZB für die Währungspolitik hinaus und würden damit in die Zuständigkeit der Mitgliedsstaaten eingreifen. Um nicht in den Verdacht der verbotenen Staatsfinanzierung zu geraten, hat sich die Notenbank auferlegt, höchstens 33% der Staatsanleihen eines Eurolandes beziehungsweise eines einzelnen Wertpapiers zu kaufen, was den Verfassungsrichtern offenbar jedoch nicht genügt. Daher hat das Bundesverfassungsgericht einen Vorlagebeschluss an den EuGH erlassen, der, da es sich um EU-Recht handelt, entscheiden muss. Hierbei handelt es sich bereits um den zweiten Versuch, den EuGH dazu zu bewegen, der EZB striktere Vorgaben zu machen.
Angesichts des aktuell erfolgreichen Vorgehens der EZB jedoch, und in Anbetracht der Tatsache, dass die EZB in 2018 ihre Anleihenkäufe möglicherweise ohnehin zurückfahren will, ist fraglich, inwieweit das Verfassungsgericht Erfolg haben wird. Ein beschleunigtes Vorabentscheidungsverfahren ist beantragt. Mit einer endgültigen Entscheidung dürfte jedoch erst Ende des kommenden Jahres zu rechnen sein.

[value] => El Banco Central Europeo (BCE) aplica desde 2015 un programa de compra masiva de deuda pública, en el que el también participa el Bundesbank, que es principal contribuyente al capital suscrito del BCE (aporta el 25 % aproximadamente). Con el fin de combatir la deflación y fomentar la actividad económica, el BCE compra grandes volúmenes de deuda pública y otros activos, por valor de 60.000 millones de euros al mes actualmente. Está política ha sido denunciada en varias ocasiones ante el Tribunal Constitucional alemán. Según el Tribunal, existen razones significativas por las que el programa de compra de activos del BCE viola la prohibición de financiación monetaria y excede el mandato de política monetaria del banco central, invadiendo las competencias de los Estados. Para evitar las sospechas de financiación monetaria, el Consejo de Gobierno del BCE estableció un límite de compras del 33 % por país emisor, lo que, aparentemente, no es suficiente para el Tribunal Constitucional alemán. En consecuencia, la corte de Karlsruhe decidió trasladar el caso al Tribunal de Justicia de la Unión Europea, al que solicita que se pronuncie con la mayor brevedad posible mediante un “procedimiento acelerado”. Se trata ya del segundo intento de convencer al TJUE de imponer restricciones al BCE.
Vistos los buenos resultados de la política del BCE, y teniendo en cuenta que el BCE posiblemente reduzca sus compras de deuda a partir del 2018, es dudoso que el TJUE dé la razón al Tribunal Constitucional alemán. Habrá que esperar la decisión definitiva que, aun tratándose de un proceso acelerado, no se emitirá hasta finales del año que viene.
