[value] => Typischerweise wird den Regelungen zur höheren Gewalt wenig Aufmerksamkeit geschenkt. Insbesondere in langfristigen Verträgen – wie beispielsweise Rahmenlieferverträgen – können sie aber in unserer globalisierten Wirtschaft und bei just-in-time-Lieferungen schneller als erwartet Bedeutung erlangen.
Welche Konsequenzen es für die Vertragsparteien hat, wenn eine Partei ihre Leistung in Folge von Natur-katastrophen (Erdbeben, Überschwemmungen, Vulkanausbrüche), Streiks, Generalstreiks, Terrorakten oder kriegerischen Auseinandersetzungen vorübergehend oder absehbar endgültig nicht erbringen kann, sollte nicht dem Zufall überlassen bleiben.
Denn nicht einmal der Begriff “höhere Gewalt“ ist im deutschen Recht gesetzlich definiert. Nach der höchstrichterlichen Rechtsprechung liegt höhere Gewalt vor, wenn “ein von außen kommendes, keinen betrieblichen Zusammenhang aufweisendes und auch durch die äußerste vernünftigerweise zu erwartende Sorgfalt nicht abwendbares Ereignis“ die Leistung einer der Vertragsparteien stört oder unmöglich macht. Der “normale“ Streik fällt nach dieser Definition nicht unter die höhere Gewalt, weil er aus der Risikosphäre der bestreikten Vertragspartei herrührt. Ebenso wenig fallen unter die Definition der höheren Gewalt Probleme bei der Belieferung mit Rohstoffen oder Zulieferteilen aufgrund eines Ereignisses der höheren Gewalt bei dem Zulieferer.
Deshalb ist zu empfehlen, die Situationen, bei denen eine der Vertragsparteien wegen höherer Gewalt ohne Schadensersatzverpflichtung von der Leistungspflicht befreit sein soll, ausdrücklich im Vertrag zu regeln. Allerdings ist bei Allgemeinen Lieferbedingungen Vorsicht geboten, weil die Definition in derartigen Klauselwerken unter Umständen einer gerichtlichen Inhaltskontrolle unterliegt.

Sin embargo, especialmente en los contratos de larga duración -tales como contratos marco de suministros- pueden cobrar más importancia de lo esperado en una economía globalizada como la nuestra para las entrega en plazo.
Las consecuencias que se producen para las partes contractuales cuando una parte no puede cumplir con su prestación de manera temporal o definitiva debido a catástrofes naturales (terremotos, inundaciones, erupciones volcánicas), huelgas, huelgas generales, actos terroristas o conflictos armados no se deberían dejar al azar.
Pero ni siquiera el concepto “fuerza mayor” ha sido definido en el Derecho alemán. Según la jurisprudencia del Tribunal Supremo alemán existe fuerza mayor cuando “un suceso externo, que no guarda relación dentro de los cálculos ordinarios y que no se puede evitar aun empleando el máximo cuidado razonablemente esperado” dificulta o impide el cumplimiento de la prestación de una de las partes. Según esta definición, la huelga “normal” no puede considerarse fuerza mayor porque deriva de la esfera de riesgos de la parte contratante que está sufriendo una huelga. Tampoco pueden englobarse bajo la definición de fuerza mayor los problemas de suministro de materias primas o piezas debido a algún suceso de fuerza mayor en los proveedores.
Por ello, resulta recomendable regular expresamente en el contrato las situaciones en las que una de las partes contractuales debe quedar liberada de su obligación de prestación por causa de fuerza mayor sin necesidad de indemnizar a la otra parte. Conviene, sin embargo, ser prudente respecto a las condiciones generales de entrega, ya que, en determinadas circunstancias, la definición contenida en tales cláusulas puede quedar sujeta a revisión judicial.
