[value] => Das spanische Tribunal Supremo hat das Urteil bestätigt, dass die einzige Verwalterin einer Immobiliengesellschaft (Dal Construcciones S.L.) wegen einer strafbaren Insolvenz verurteilt hatte.
Die Gesellschaft erhielt eine Reihe von Wechseln für die ausgeführten Arbeiten, aber der Betrag dieser Wechsel (148.000 Euro) wurde nicht auf das Konto der Gesellschaft, sondern auf die persönlichen Konten der Angeklagten eingezahlt, zu denen auch die einzige Verwalterin zählte.
Nach kurzer Zeit wurde die Gesellschaft an einen Dritten veräußert, und zwar für einen symbolischen Preis von 12.000 Euro, dies im Wissen um die Krise der Gesellschaft. Kurz darauf wanderte der Käufer nach Chile aus und kümmerte sich nicht mehr um die Angelegenheit, so dass sich die Befriedigungsaussichten der Gläubiger verschlechterten. Vier Gläubiger klagten gegen die einzige Verwalterin der Dal und die für die Buchhaltung und Steuerangelegenheiten verantwortliche Person, da diese Geld auf ihren persönlichen Konten erhalten hatten.
Das Tribunal Supremo bestätigte mit Urteil vom 17. Mai die Verurteilung wegen der Insolvenzstraftat, wobei es davon ausging, dass alle Tatbestandsmerkmale des Delikts erfüllt seien: Bestehen einer Forderung, Unterdrückung der Vermögenswerte, Minderung des Schuldnervermögens und der Vorsatz zur Gläubigerschädigung (da die erzielten Beträge nicht zur Befriedigung der Gläubiger eingesetzt wurden).
In diesem Fall hat das Tribunal Supremo die Vorschrift in besonderer Weise ausgelegt, denn der “geflüchtete” Käufer der Gesellschaft wurde nicht verurteilt.

La empresa recibió diversos pagarés por los trabajos que había realizado, si bien el importe de éstos, unos 148.000 euros, no fue ingresado en la cuenta de la sociedad sino en las cuentas personales de los acusados, entre los que se encontraba la administradora única.
Al poco tiempo la empresa fue vendida a un tercero por un precio simbólico de 12.000 euros, a sabiendas el comprador de que la empresa estaba en crisis. Poco tiempo después el comprador se marchó a Chile desentendiéndose de la entidad, que quedó a la deriva de modo que los acreedores de Dal vieron frustradas sus legítimas expectativas de percibir sus créditos recientemente constituidos. Cuatro de sus acreedores se querellaron contra la administradora única de DAL y la persona que llevaba la contabilidad y los temas fiscales, pues fueron éstos quienes recibieron el dinero en sus cuentas personales.
El Tribunal Supremo mediante sentencia de 17 de mayo del presente año ratificó la condena de los acusados, que fueron sancionados por un delito de insolvencia punible al entender que se daban todos los elementos del delito, es decir: la existencia de un crédito previo contra el sujeto activo del delito, la ocultación de sus activos, la disminución del patrimonio y el ánimo de defraudar las legítimas expectativas de los acreedores de cobrar sus créditos, pues derivó los importes de los pagos recibidos en lugar de saldar las deudas de los acreedores.
En este caso el Tribunal Supremo ha realizado una versión mejorada de la típica conducta delictiva pues el comprador, que es el que “huye”, no resultó juzgado.
