[value] => Es ist nicht unüblich, dass spanische Unternehmen ihren Führungskräften, vor allem den Nichtresidenten, als Bestandteil des „Gehaltspakets“ eine Wohnung in Spanien zur Verfügung stellen.
Gemäß Artikel 20.Eins.23º.b) des spanischen Umsatzsteuergesetzes stellt die Vermietung von Gebäuden oder eines Teils derselben, welche ausschließlich zu Wohnungszwecken vermietet werden, grundsätzlich eine von der spanischen Umsatzsteuer („I.V.A.“) befreite Dienstleistung dar. Diese Befreiung erstreckt sich zudem auf Garagen, dazugehörende Anbauten und Möbelstücke der Wohnung, welche mitvermietet werden.
Nun stand der ebenso nicht unübliche Fall zur Debatte, in dem das Unternehmen selbst als Mieterin des Mietvertrages auftritt und dann im Anschluss die Nutzung der Wohnung an den Mitarbeiter abtritt. Fragestellung: Greift auch in diesem Fall die Befreiung von der spanischen Umsatzsteuer?
Laut einer Entscheidung des sogenannten zentralen Wirtschafts- und Verwaltungsgerichtshofs („Tribunal Económico-Administrativo Central“) vom 15. Dezember 2016 (Az.: RG 3856/2013) greift die Umsatzsteuerbefreiung nur für den Fall, wenn einerseits im Mietvertrag diejenige Person genau bezeichnet ist, welche die Wohnung bewohnen wird, und andererseits im Vertrag ein Verbot zur Untervermietung festgelegt ist (d.h., es dürfen keine weiteren Abtretungen oder anderweitige Zuteilungen erfolgen). Es handelt sich somit um eine sehr restriktive Auslegung, auch wenn sich diese auf europäische Rechtsprechung stützt (EuGH, 04.10.2001 - C-326/99 „Goed Wonen“).

[value] => No resulta infrecuente que las empresas españolas, como parte integrante del paquete retributivo, pongan a disposición de sus directivos, sobre todo a disposición de sus directivos “impatriados”, la vivienda en la que van a residir en España.
Con carácter general el alquiler de edificios o parte de los mismos destinados exclusivamente a viviendas constituye una prestación de servicios exenta de IVA, conforme establece el artículo 20.Uno.23º.b) de la Ley del IVA. Es más, la exención se extiende a los garajes y anexos accesorios a las viviendas y los muebles arrendados conjuntamente.
Con respecto a esta cuestión ha sido objeto de discusión el caso, también típico, en el que es la propia empresa la que figura en el contrato de arrendamiento como la persona arrendataria, que luego cede su uso al empleado. ¿Cabe la exención a IVA en tal supuesto?
Pues bien, conforme establece una resolución del Tribunal Económico-Administrativo Central de 15 de diciembre de 2016, RG 3856/2013, solo cabe la exención de IVA en tal supuesto cuando, en primer término, se señale en el contrato específicamente la persona que va a ocupar la vivienda y, en segundo término, se indique en el contrato que no cabe el subarriendo (que no quepa la posibilidad de ulteriores cesiones o designaciones). Se trata, por tanto, de una interpretación muy restrictiva, sin bien se dice respaldada por jurisprudencia comunitaria (sentencia “Goed Wonen”, de 4 de octubre de 2001).
