[value] => Zivilprozesse verursachen neben den Anwaltsgebühren auch nicht unerhebliche Gerichtskosten, die schon mit der Einreichung der Klage beim Gericht eingezahlt werden müssen. Im Laufe des Verfahrens können sich diese Kosten durch unachtsames Verhalten der Parteien allerdings noch erhöhen und dies ist vielen nicht bekannt. Eine solche Erfahrung mussten Kläger in einem Verfahren vor dem Landgericht Hannover machen, die der Aufforderung zum persönlichen Erscheinen im Termin zur mündlichen Verhandlung nicht nachgekommen waren. Das Landgericht Hannover hat der Klägerpartei in einem solchen Fall kürzlich eine zusätzliche volle Gerichtsgebühr in Höhe von rund 500,00 € aus dem vollem Streitwert auferlegt, weil durch das Fernbleiben des Klägers ein neuer Termin zur mündlichen Verhandlung anberaumt werden musste und sich dadurch der Rechtsstreit verzögerte. Das Oberlandesgericht Celle hat diese Entscheidung auf einen Rechtsbehelf der Klägerin hin bestätigt (Beschluss vom 28. August 2017 – 11 W 31/17).
Das Gericht kann das persönliche Erscheinen einer Partei anordnen, wenn dies zur Aufklärung des Sachverhalts geboten erscheint. Es teilt dann schon in der Ladung mit, dass im Falle des Nichterscheinens ein Ordnungsgeld (bis zur Höhe von 1.000,00 €) festgesetzt werden kann. Auf die sogenannte Verzögerungsgebühr muss das Gericht allerdings nicht hinweisen. Und diese kann – je nach Streitwert – noch wesentlich höher liegen, bei einem Streitwert von 1.000.000 € beispielsweise bei bis zu ca. 21.000,00 €.
Eine persönliche Ladung zum Erscheinen (beispielsweise des Geschäfts-führers einer GmbH) ist deshalb nicht auf die leichte Schulter zu nehmen. Wenn die geladene Person einen triftigen Grund hat, muss sie sich entsprechend entschuldigen und über ihre Anwälte bereits im Vorfeld eine Terminverlegung beantragen lassen.

[value] => Además de los honorarios de los abogados, los procesos civiles conllevan también significativos gastos judiciales, que deberán ser abonados junto con la presentación de la demanda ante el Tribunal. Sin embargo, en el curso del procedimiento estos gastos pueden verse incrementados por un comportamiento negligente de las partes, algo que muchos desconocen. En un proceso judicial ante el Tribunal Regional de Hannover, los demandantes que incumplieron su obligación de comparecencia personal a la audiencia del juicio oral debieron vivir tal experiencia. En este caso, el Tribunal Regional de Hannover impuso a la parte demandante una tasa judicial adicional por un importe de 500,00 €, aproximadamente, derivada de la cuantía del litigio, ya que debido a la ausencia del demandante debía ser señalada una nueva fecha para el juicio oral, demorando así el procedimiento. El Tribunal Superior Territorial de Celle confirmó esta decisión, como resultado del recurso presentado por la demandante (Sentencia de 28 de agosto de 2017-11 W 31/17).
El tribunal puede ordenar la comparecencia personal de las partes si lo considera necesario para aclarar los hechos. En la solicitud de comparecencia ya se informa de que en caso de no comparecer se puede imponer una multa administrativa (hasta un importe de 1.000,00 €). No obstante, el tribunal no debe señalar la denominada multa por demora del procedimiento. Y esta puede ser aún mucho más elevada -dependiendo de la cuantía del litigio-, por ejemplo, si la cuantía del litigio asciende a 1.000.000 €, hasta 21.000,00 € aprox.
Por ello, una solicitud de comparecencia personal (por ejemplo, del administrador único de una GmbH) no debe tomarse a la ligera. Si la persona citada tuviere motivos fundados deberá excusarse debidamente y sus abogados podrán solicitar un aplazamiento por adelantado.
